Hello friends I am writing my first ever article on medium.
This is my first article on which I would like to attract your attention towards the act named “THE PREVENTION ATROCITIES ACT”(POA) or nowadays commonly known as “Sc/St act”.
The SCs and STs (Prevention of Atrocities) Act, 1989 with stringent provisions (which extends to whole of India except the State of Jammu & Kasmhir) was enacted on 9 September 1989. Section 23(1) of the Act authorises the Central Government to frame rules for carrying out the purpose of the Act. Drawing power from this section, the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Rules of 1995 were framed. The rules for the Act were notified on 31 March 1995.
The purpose of the Act was to help the social inclusion of Dalits into Indian society, but the Act has failed to live up to its expectations admitted by the Union Minister for Home Affairs in parliament on 30 August 2010 (quoted below).
-It punishes crimes against people belonging to Scheduled Castes and Tribes.
-It gives special protections and rights to victims.
-It sets up courts for fast completion of cases.
What sorts of crimes are punished?
-Some crimes under the IPC are given increased punishments under this law.
-Cruel and degrading crimes that occur very often against SC/ST such as forcing them to eat cowdung, boycotting them socially etc. More than 20 such acts are punished under this law.
But nowadays this act is deadly for india society specially for General caste and OBC caste.
In this law few weeks ago supreme court tries to lose the law and then remove the law but enforcement of running government on supreme court and the government hardens the law and make changes in law and now if a harijan or sc/st caste people fights with you and if he/she complaints in police so police may arrest you.You got 6 months imprisonment.And you not have chance to fight for it.
As the law is passed by government the people of other caste make all tries to unpass the law and do many things for example “Bharat Band” and other attempts to enclose the law.
I think those you are reading may understand the situation of General and OBC caste people.
