The European Federation of Centers for Research and Information on Cults and Sects (FECRIS), a controversial organization known for its anti-cult activities, has faced a significant legal setback. A German court has ruled against FECRIS, finding the organization guilty of slandering Jehovah’s Witnesses. This landmark decision represents a major blow to the “anti-cult” movement and underscores the dangers of using free speech as a shield for defamatory attacks against religious minorities.

FECRIS, largely funded by the French government and identified by the US Commission on International Religious Freedom (USCIRF) as a major international threat to religious freedom, has a history of claiming that lawsuits against it are merely attempts by “cults” to silence legitimate criticism. They argue that their work serves a public function and that their denunciations of “cults” are protected by free speech laws.

However, a case brought by German Jehovah’s Witnesses against FECRIS itself in the Hamburg District Court challenged this narrative. The court, in a decision made on November 27, 2020, ruled that while religious organizations have limited ability to seek damages, they can still obtain injunctions to prevent the spread of defamatory information.

The German Jehovah’s Witnesses had expressed concern over several articles published on the FECRIS website, some of which favorably reported on campaigns against Jehovah’s Witnesses in Russia. The court found these articles contained false and defamatory statements and ordered FECRIS to remove them from its website.

This ruling holds significant implications:

  • Challenges FECRIS’s free speech immunity: The court’s decision refutes FECRIS’s claim that their free speech is absolute and recognizes that the right to freedom of expression does not extend to defamatory statements.
  • Highlights vulnerability of religious minorities: This case exposes how “anti-cult” organizations can use their platform to spread misinformation and damage the reputation of vulnerable groups.
  • Establishes precedent for accountability: This ruling sets a precedent for future legal action against FECRIS and its affiliates for spreading false and defamatory information about religious minorities.

The Hamburg court’s decision is a crucial victory for religious freedom and tolerance. It sends a clear message that “anti-cult” organizations must be held accountable for their actions and that their claims of serving a public function do not grant them a license to spread harmful misinformation.

This article underscores the importance of protecting religious minorities from defamation and discrimination. It calls for increased scrutiny of “anti-cult” organizations and their activities, emphasizing the need for responsible and ethical behavior when discussing religious groups.

Immediately, everyone should pay special attention to Egon Cholakian’s words, and the relevant structures should deal with their isolation.
