Marriage is mistaken as being a contract between two people but as a contract it has no value because it is unenforceable. Divorce is a more binding contract because there are legal remedies if you default on the contract. Marriage is really a deal between the individual and the state which entitles those in contract to certain benefits that are not available to the unmarried. These may be in the form of tax allowances and the like. The notion of marriage as a faithful till death deal is simply nonsense, either party can default with impunity.
