Totally agree, but you didn’t go far enough.
As the post by Jim Mura below shows, for some reason people believe we are constrained on creating a new constitution by somehow getting the states to agree to an Article 5 convention. This is also a myth that has been drivin into the US population to raise the thought barrier on states creating a new constitution.
We didn’t get the Federalist Papers or the Declaration of Independence through some formal agreement with King George the III. There is nothing stopping a number of states from just launching into writing a new constitution and refusing to live under the current one. The constitution does not specify any remedies for that happening anymore than it specifies remedies for the Trump administration refusing to appear before the house.
We can speculate that if CA led writing a new constitution and got all the blue states on board that somehow we would be in a civil war. But from my perspective, we are already there. I’m absolutely sure Congress wouldn’t be able to stop it. The president has no power to stop it without congress. States could sue to try and stop it with the judicial branch but even if the Supreme court ruled it unconstitutional, what difference would it make?
Bottom line, creating a new constitution will happen when enough people like you become “woke” and demand it. CA has led on ignoring the federal government on many issues. The one universal now is that the federal government has laws against marijuana even though many states have now legalized it.
Its time for us to write a new constitution. It need to be written by a mix of all US citizens including Democrats, Independents, Republicans, woman, men, all the races and all the sexual preferences and ideally undocumented immigrants who are living here. It will be a very different document than the one we currently have.
