Supreme Court Verdict on Uttarakhand — A resounding victory of Constitutional Democracy

Landmark history was written today as Constitutional democracy achieved a shining victory with a path breaking verdict of Supreme Court of India in case of ‘Devbhumi’ Uttarakhand. It is a decisive defeat of forces who sought to trample upon democracy, subjugate constitution and hold the will of people to ransom by engineering defections and misusing money and muscle power with a view to destabilize elected Governments.

Our consistent stance has been vindicated. Once again, “Floor Test” has been mandated as the only remedy to settle the issue of alleged chaos, or alleged corruption as laid down by a Nine Judges bench in “Bommai’s case” and another five Judges bench in “Ramashwar Prasad”s case.

On 18th March, 2016; Uttarakhand Assembly passed Appropriation Bill by voice vote. On 19th March, 9 Cong. MLAs were lured away by BJP through misuse of muscle and money power. On 20th March, Governor of Uttarakhand announced floor test to be held on 28th March, 2016.

Just a day before the floor test, i.e. on 27th March, Modi Government murdered democracy by imposing President’s Rule after calling an emergency meeting of Union Cabinet on the night of 26th March. Never before was such scant disregard for constitution and people’s will shown by any other Union Government.

A single Bench of Uttarakhand High Court upheld Congress Party’s claim for a floor test with a rider that 9 disqualified rebel MLAs could vote. This was reversed by a Division Bench of Uttarakhand High Court which quashed the President’s Rule and directed a floor test minus the 9 MLAs.

Matter is now pending in Hon. Supreme Court. Supreme Court has now issued a direction for holding of floor test on 10th May minus the nine disqualified MLAs. Congress Party is confident that with the blessings of people of Uttarakhand, will of people will be restored and Congress Government will win the trust vote.

Prime Minister, Shri Narendra Modi and BJP must now step down from their high pedestal of arrogance of power and reflect in the mirror of truth. Let the will of people of Uttarakhand prevail. Prime Minister Shri Narandra Modi must, in hindsight, tender an unqualified apology to people of Uttarakhand as also to entire country and publicly take a vow to never conspire to unseat elected Governments. This is the only way to strengthen and sustain India’s Cooperative Federalism.
