Isn’t the issue much broader than direct-to-consumer DNA analysis? The federal Food, Drug, and Cosmetic Act of 1938, as amended, poses a major impediment to a variety of health-related tests, wearables, and apps. Reform is certainly overdue, but narrow carve-outs probably aren’t the right answer.
