The treatment of Chand and Semenya on the part of their sports’ controlling bodies, opponents, media and the public have been horrifying to be sure. As an intersex person I’ve been deeply disturbed. I do see their participation in their sports, as you write, as a civil rights issue for them. At the same time I see my litigation in California court to create a third gender designation, Non-Binary, which was recently court-ordered in Oregon, as a civil rights issue for me and other intersex people for whom the current gender structure is oppressive, cruel, lie-perpetuating and scientifically inaccurate. We will need to find a way to express the gender identification of all intersex people based on their gender-identification and self-definition and respect the personal truth in all positions. This is ultimately a most personal, self-defining distinction for each individual. I cheer for Chand and Semenya at the same time I cheer for those of us fighting the “Non-Binary” battle.
