My only critique is on: “that is, a form of government where ‘we the people’ ultimately rule.” I’d argue more for the view that legal scholar Randy Barnett takes—that government protects the liberty of “we the people” as individuals. The other view can be understood as the right of majorities to impose their wills. I don’t think the latter is accurate.
