All Cities & Towns in The Region Have Access For Fishing But Gary Indiana

Gary Indiana’s population is 93% minorities and the city is run like a 3rd world country.

The Analytical Data shows that the countries who supply Gary Indiana / the regions fish are from China and Vietnam who would be affected if we are allowed to fish in lake Michigan are following my post on Facebook and this blog.

Could there be something else going on?

How much fish does the region consume from south east Asia , Vietnam Taiwan etc what impact if any would it have if we are allowed to fish and fill our freezers with lake trout Salmon, Perch , Bass , how would it effect people living below the poverty level would the state try to regulate the person who lives below the poverty level and receives benefits by putting a dollar value on the fish in their freezers!

We can help the trade imbalance and consume fish without so many toxins and cut down on health expenses if we are allowed to fish in Lake Michigan.

This African American is fishing for survival in a combined sewer in the Calumet River. The humiliation and the shame we are put through. The billions of dollars we have received squandered away in areas of squalor instead of bulldozing the mess and starting over.

The National Parks Service dropped the case. They stonewalled the people for over 2 years for nothing ! They said they did not have jurisdiction!

The people can’t go fishing in Lake Michigan in Gary Indiana and Obama does not care we pay for fishing licenses and the money is supposed to go toward gaining access.

The Lake Michigan Coastal Program For The City Of Gary Indiana has a couple of vacant positions and the city of Gary is not represented and the city is trying very hard not develop the Lake front according to the wishes of the people

They are misusing and abusing us and we are tired of our African American leaders they are nothing more than poverty pimps!

The abundant fish resource in lake Michigan in Gary Indiana can help many who live below the poverty level This one Salmon is worth over $100 and there are billions that come back annualy and spawn and die.

There is a National Park in Gary Indiana that sits on Lake Michigan (National Lake shore ) in the park there is The Grand Calumet River AKA Marquette Park Lagoon that is toxic the park is abutted by United States Steel Coke Plant that has just been shut down. In all other cities where coke plants have been closed The EPA and Super-fund and other stake holders have mapped out plans of remidation. I have inquired to the EPA , National Parks , Congressman Peter Visclosky & National Parks Conversation Society.

When the government violates The Public Trust Doctrine and the GAO Refuses to Act !

I. Overview: Interplay of Title VI with Title IX, Section 504, the Fourteenth Amendment, and Title VII

Title VI prohibits discrimination on the basis of race, color, or national origin in programs and activities receiving Federal financial assistance. Specifically, Title VI provides that

[n]o person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.

42 U.S.C. § 2000d. Title VI is the model for several subsequent statutes that prohibit discrimination on other grounds in federally assisted programs or activities, including Title IX (discrimination in education programs prohibited on the basis of sex) and Section 504 (discrimination prohibited on the basis of disability). See U.S. Department of Transportation v. Paralyzed Veterans, 477 U.S. 597, 600 n.4 (1986); Grove City College v. Bell, 465 U.S. 555, 566 (1984) (Title IX was patterned after Title VI);Consolidated Rail Corp. v. Darrone, 465 U.S. 624 (1984) (Section 504 patterned after Titles VI and IX).(1) Accordingly, courts have “relied on case law interpreting Title VI as generally applicable to later statutes,” Paralyzed Veterans, supra, 477 U.S. at 600 n.4.

It is important to note, however, that not all issues are treated identically in the three statutes. For example, Title VI statutorily restricts claims of employment discrimination to instances where the “primary objective” of the financial assistance is to provide employment. 42 U.S.C. § 2000d-3. No such restriction applies to Title IX or Section 504. See North Haven v. Bell, 456 U.S. 512, 529–30 (1982) (“The meaning and applicability of Title VI are useful guides in construing Title IX, therefore, only to the extent that the language and history of Title IX do not suggest a contrary interpretation.”);Bentley v. Cleveland County Board of County Commissioners, 41 F.3d 600 (10th Cir. 1994) (Section 504 claim alleging discriminatory termination of former employee).

Apart from the provisions common to Title VI, Title IX, and Section 504, courts also have held that Title VI adopts or follows the Fourteenth Amendment’s standard of proof for intentional discrimination, and Title VII’s standard of proof for disparate impact. See Elston v. Talladega County Board of Education, 997 F.2d 1394, 1405 n.11, 1407 n.14 (11th Cir.), reh’g denied, 7 F.3d 242 (11th Cir. 1993); (see Chapter VIII). Accordingly, cases under these constitutional and statutory provisions may shed light on an analysis concerning the applicability of Title VI to a given situation.

Buffington Harbor Pier In Gary Indiana July 2,2015 we were kicked off the pier by Majestic Star Casino Security and told to leave they are in violation of the use permit granted by the United States Army Corp Of Engineers.

The Majestic Star Casino said they do not own the piers yet their security told us to leave! I know I was not looking at the camera I was looking at the employees on telephones calling security !

On July 2,1964 the civil rights act of 1964 was signed. It has been 51 years and we still do not have equality when it comes to fishing in Gary Indiana.

The United States Army Corp Of Engineers is working for the public in all communities but Gary Indiana it refuse to enforce it use permits at the Majestic Star Casino.

When do we get equality there are no plausible excuses ?

USDA to invest $20 million to help 15 states increase recreational public access on private farm, ranch, and forest lands

WASHINGTON, Aug. 17, 2015 — Agriculture Secretary Tom Vilsack today announced that the U.S. Department of Agriculture will invest $20 million to partner with 15 state agencies to improve and increase wildlife habitat and public access for recreational opportunities on privately-owned and operated farm, ranch and forest lands. The projects are being funded under the Voluntary Public Access and Habitat Incentive Program (VPA-HIP).

“Our partnerships with state governments will help them work with interested landowners to enhance hunting and fishing and other wildlife-dependent recreation, to enhance wildlife habitat, and to protect wildlife species and encourage new opportunities for local businesses,” Vilsack said. “These projects are excellent examples of USDA’s successful efforts to connect public and private partners for long-term conservation gains that benefit sportsmen, wildlife, private land owners, and the public.”

The selected state governments will encourage owners and operators of privately held farm, ranch or forest land in their respective states to voluntarily open their land for hunting, fishing and other wildlife-dependent recreation and to improve fish and wildlife habitat on that land.

USDA’s Natural Resources Conservation (NRCS) awarded grants for projects in Colorado, Connecticut, Illinois, Kansas, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Oklahoma, Oregon, Washington, Wisconsin and Wyoming.

This fiscal year’s selected projects include:

Massachusetts — The state’s Mohawk Trail Woodland Community Habitat Program will use the VPA-HIP grant of approximately $836,500 to build on an existing Regional Conservation Partnership Program project designed to create wildlife habitat in a 28-town region in western Massachusetts. The state will create and improve recreational opportunities with a flexible program to ensure all citizens, including low income residents, can participate and enjoy benefits such as hunting, fishing and wildlife watching on about 10,000 acres of private forestland.

Nebraska — The Nebraska Game and Parks Commission will use the VPA-HIP grant of $1.35 million to improve and expand its efforts to open private land to hunting, fishing, and other compatible public recreation activities. These funds will enable new access to up to 260,000 land acres, 400 new surface acres, and 55 new miles of streams and rivers for hunting and/or fishing.

Washington — The Washington State Department of Fish and Wildlife will use the VPA-HIP grant of approximately $1.4 million to expand access on up to 60,000 acres of upland bird hunting in the Southeast Washington, up to 10,000 acres of deer and turkey hunting access Northeast Washington and Klickitat County, and deer hunting access on sites near the Puget Sound urban center on small ownerships. They will also focus on waterfowl hunting access on sites near the Puget Sound urban center and encourage practices that provide important food resources to birds wintering in the region.

According to a 2013 study commissioned by the National Fish and Wildlife Foundation, the outdoor recreation economy in the United States supports 6.1 million direct jobs, $80 billion in federal, state, and local tax revenue, and $646 billion in spending each year. In evaluating proposals for funding, NRCS looked for projects that would:

  • Increase private land acreage available for public use;
  • Offer a public access program that gains widespread acceptance among landowners;
  • Make special efforts to reach historically underserved or socially disadvantaged landowners;
  • Ensure appropriate wildlife habitat is located on enrolled land;
  • Strengthen existing wildlife habitat improvement efforts;
  • Follow NRCS conservation practice standards for VPA-HIP habitat improvement activities; and;
  • Inform the public about the locations of existing and new lands where public access is available.

When Congress reauthorized VPA-HIP in the 2014 Farm Bill, Secretary Vilsack assigned administration of the program to NRCS. In fiscal years 2014 and 2015, USDA has invested the Farm Bill-authorized $40 million for VPA-HIP, which has helped 21 states and one tribal nation complete projects to increase wildlife-dependent outdoor recreation opportunities.

Under VPA-HIP, state and tribal governments apply for grants to encourage owners and operators of privately held farm, ranch or forest land to voluntarily open that land for public wildlife-dependent recreation activities such as fishing, hunting and birding. State and tribal governments may use VPA-HIP funds to create new public access programs, to expand existing public access programs, and to improve wildlife habitat on enrolled public access program lands. Projects can span up to three years

The government says they are equal opportunity providers yet we can’t go fishing in Lake Michigan in Gary Indiana.

LAKE & RIVER ENHANCEMENT PROGRAM

The goal of the Division of Fish and Wildlife’s Lake and River Enhancement Section is to protect and enhance aquatic habitat for fish and wildlife, to insure the continued viability of Indiana’s publicly accessible lakes and streams for multiple uses, including recreational opportunities. This is accomplished through measures that reduce non-point sediment and nutrient pollution of surface waters to a level that meets or surpasses state water quality standards.
To accomplish this goal, the LARE Program provides technical and financial assistance for qualifying projects. Approved grant funding may be used for one or more of the following purposes:

  1. Investigations to determine what problems are affecting a lake/lakes or a stream segment.
  2. Evaluation of identified problems and effective action recommendations to resolve those problems.
  3. Cost-sharing with land users in a watershed above upstream from a project lake or stream for installation or application of sediment and nutrient reducing practices on their land.
  4. Matching federal funds for qualifying projects.
  5. Feasibility studies to define appropriate lake and stream remediation measures.
  6. Engineering designs and construction of remedial measures.
  7. Water quality monitoring of public lakes.
  8. Management of invasive aquatic vegetation
  9. Sediment removal from qualifying lakes.
  10. Logjam removal from qualifying rivers.

What types of projects may be funded?
Grant applications may consist of land acquisition and/or facility construction or renovation for local public parks for outdoor recreation. New parks or additions to existing parks may be funded.

The land acquisition or development may not be started until final approval is received from the Federal Government. All land to be developed must be controlled by the park board through direct ownership. Examples of types of projects include:

  • Acquiring park or natural area
  • Picnic areas
  • Sports and playfields, such as playgrounds, ballfields, court facilities and golf courses
  • Water oriented facilities for boating, swimming, and access to lakes, rivers and streams
  • Natural areas and interpretive facilities
  • Campgrounds
  • Fishing and hunting areas
  • Winter sports facilities
  • Amphitheaters and bandstands
  • Parks adjacent to schools for mutual use
  • Outdoor natural habitat zoo facilities
  • Roads, restrooms, utilities, park maintenance buildings
  • Nature Centers

All facilities should be universally designed for persons with disabilities and the Park board’s facilities, programs and activities must be open to the public without discrimination on the basis of race, color, national, origin, age.

The government paid for this harbor for the public and the city of Gary Indiana sold it without public input illegally!

They claim not to own the piers and they do not know who owns them but they told us to leave !

I have exhausted all other remedies the Casinos have not lived up to their agreement with the public and the United States Army Corp Of Engineers use permit which is transferable to the new owners. Who have failed to comply with the use permit for the parking garage and pier built in Lake Michigan.

Therefore I have requested the Indiana Gaming Commission Suspend the Majestic Star Casino’s license for failure to comply.

The wonderful lies that were told in the development of Buffington Harbor in Gary Indiana re file no; 93–056–0743 re the public gaining access to use the jetties wharfs & piers for fishing has never occurred and is past the point of give them another chance or a little bit more time the use permits were never intended for the public and the subsequent owners are not to be found and are no more than a shell corporation. Therefore I respectfully request that the use permits be terminated immediately and the land be returned to the public / the parks department of lake county Indiana. Have the piers been deeded that sit in Lake Michigan?

These are areas we once had access to in Gary Indiana for fishing it will take an effort of the entire region and the state of Indiana and the federal government to make it accessible to all to enjoy. Today United States Steel legal team has contacted me and has said they will adhere to the law. (BUT) IT WILL NOT BE GIVING ANY EASEMENTS . We need philanthropic organizations to help pave the way to the riparian zones in the public domain.

We now need easements to the lake front to get to the riparian zone on the west side of Gary. The walk to the east break wall and riparian zones by the coke plant on lake Michigan next to the National Lakeshore is lengthy and leaves out the aged and disabled from enjoying the lake front. There is much work to still do and the struggle continues.

There is not one pace to fish in Gary Indiana from the shore in Lake Michigan and the only place inland is a Jim Crow fishing spot in a retention pond full of stunted pan fish loaded with carps and bull heads and its a pay pond.
