Case of Sexual Penetration Committed to High Court

Magistrate Dr. Binneh Kamara of the Freetown Magistrate Court №1 has on Wednesday August 31, 2016 committed to the High Court Ezekiel Mohamed Marcus Bassie, 36, who is accused of involving in an act of sexual penetration with a 12-year-old girl.

“I have gone through the evidence in this matter and I’m satisfied that the accused person Ezekiel Mohamed Marcus Bassie does have questions to answer pursuant to the offence as charged. I hereby commit this matter to the high court for trial without bail for interfering with the proceedings,” the presiding magistrate said.

The magistrate further said that it was the child who brought to the attention of the court that the accused had interfered with the witness, adding that the child also stated that her mother had compromised with the accused.

The police prosecutor told the court that the child said the accused had started begging her mother even before the case was sent to the police.

In his testimony, the formal witness, Detective Police Constable 13372 Foday Malik Bangura, who is attached to the Family Support Unit (FSU) at the Lumley Police Station, said that he recognized the victim and the accused person. He told the court that he recalled on June 5, 2016, while he was on duty at FSU, a young lady accompanied her 12-year-old sister to the station where she reported an alleged case of sexual penetration against the accused.

He explained that the matter was transferred to him for investigation. He also said that he issued a police medical request form to the complainant on behalf of her sister (the victim), adding that she later returned with the medical form. He produced and tendered the medical form, and it was marked as exhibit A1- A3.

He said that on the same day, the complainant and her neighbours arrested the accused and took him to the police station. He furthered that he obtained statement from the alleged victim and her witness.

“I visited the alleged scene of crime, but nothing of police interest was found,” constable 13372 Foday Malik Bangura disclosed.

He told the court that he charged the accused person with sexual penetration on August 9, 2016.

According to the particulars of offence, the accused person had been sexually penetrating a 12-year-old child on diverse dates between April 2016 and May 2016.
