If a private school receives any Federal dollars, it is subject to Title IX, which protects all students from sex discrimination. From the US Dept. of Education:

“All public and private elementary and secondary schools, school districts, colleges, and universities receiving any federal financial assistance…must comply with Title IX.”

“All students (as well as other persons) at recipient institutions are protected by Title IX — regardless of their sex, sexual orientation, gender identity, part- or full-time status, disability, race, or national origin — in all aspects of a recipient’s educational programs and activities.”
