Delhi still a UT; High Court upholds authority of Lieutenant-Governor
A batch of petitions filed by Delhi’s Aam Aadmi Party government has been dismissed by the Delhi HC a few minutes ago. The Court relied on Article 239 (Administration of Union Territories), read with Article 239AA (Special Provisions with respect to Delhi) to hold that Delhi remains a Union Territory and has not been converted into a State by the 69th Amendment. This entails that the Lt.-Governor of Delhi is not bound by the advice of Delhi’s Council of Ministers. Post may be updated after analysis of the complete judgment. The Supreme Court has ordered that hearings on the appeal filed against the above judgment by the Delhi government will be heard on November 15th.
