Thanks for this, Ben. What would happen in the odd scenario where there’s a massive layoff and employees all receive severance except Poor Joe who quit two days before? Could Joe rescind on the basis that the employer already had the intention of dismissing them and therefore should retroactively be entitled to severance or some other pay?
