Rogue Police (and their number is not small) Need to Be Taken off the Street — Two Trials Are Better Than One

Rogue police, (and their number is not small), need to be taken off the street. Threat of punishment for their crimes is a deterrent. Where federal law is violated, a defendant can have two trials, one for the state violation, and one for the federal violation.

Please call your congress members to push Justice to prioritize federal as well as state prosecution of police who kill and injure black people and people of color, under Justice Manual 9–27.230, 1. Federal Law Enforcement Priorities, which states that from time to time the Attorney General establishes “national investigative and prosecutorial priorities.”

Police can be charged under federal statute 18 USC 242 Deprivation of Rights Under Color of Law if they “willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.” Also, in many cases, 18 USC 241 Conspiracy Against Rights can be invoked “where two or more persons agree together to injure, threaten or intimidate a person…in the free exercise …of any right…secured by the Constitution.”

These are not the hate crimes statutes, which have narrower application.
