A while back I happened across an intriguing 1995 essay called The Myth of the Rule of Law by Georgetown Law professor John Hasnas. In it he lays out an anarchic and libertarian view of the rule of law, the difficulties inherent in written legislation and the politicization of law itself. Below is my layman’s attempt to understand and lay out his argument, augmented by readings of several of his other essays.
