PRIZE DRAW PROMOTION TERMS AND CONDITIONS

PRIZE DESCRIPTION: 10x H&M UK e-gift cards for £100 (one voucher per winner) valid until for 2 years from date of issue.

  1. Promoter

1.1 The promoter for this prize draw is Flux Systems Limited of Aldgate Tower 2nd Floor, 2 Leman Street, London, England, E1 8FA.

1.2 By entering this prize draw each entrant accepts these terms and conditions.

2. Who can enter

2.1 This promotion is only open to residents of the United Kingdom who are at least 18 years old and have Flux activated within their Monzo or Starling Bank app.

2.2 Employees of the promoter, its associated companies, agents, third parties and anyone else professionally connected with this prize draw, and their close family members, are not eligible to enter this promotion.

2.3 Only one entry per person.

2.4 No automated, bulk or third-party entries are permitted.

2.5 It is free to enter this prize draw and no purchase is necessary to enter this prize draw.

3. The prize

3.1 The prize consists of an H&M UK e-gift card valued at £100. There are 10 prizes to be won.

3.2 Only one winner per household.

3.3 No cash alternative to the prize will be provided. The promoter reserves the right to substitute the prize with one of equivalent or greater value.

3.4 The prize is non-transferable and non-refundable and may not be exchanged for cash or any other prize.

3.5 Third party suppliers of prizes may stipulate additional terms or restrictions and all winners agree to be bound by these.

4. How to enter

4.1 To enter the prize draw you must:

4.1.1 have Flux activated within your Monzo or Starling Bank mobile banking app; and

4.1.2 Subscribe to the Flux mailing list using this sign-up form (this will involve you entering your email address, selecting the bank you use Flux with, selecting your email preferences, and clicking “Subscribe”.

4.2 Once your mailing list subscription above is confirmed, you will automatically be entered into the prize draw.

4.3 The prize draw will be open for entries for 7 days between Monday 19 October 2020 and midnight on Sunday 25 October 2020. Entries submitted outside this period will not be accepted by the promoter.

4.4 No purchase necessary.

4.5 Any entry not in accordance with these terms and conditions and any entry containing false, misleading or incomplete information may be excluded from the prize draw.

4.6 Any instructions provided at the point of entry to the prize draw on the promoter’s website will form part of the terms and conditions of this prize draw, and will take precedence over any conflicting terms in paragraphs 1 to 9 inclusive.

5. Winner selection

5.1 The winners will be drawn at random by a computer from all valid entries received by the closing date.

5.2 The winners will be notified by email (to the address provided on entry) within 7 days of the closing date.

5.3 All reasonable efforts will be made to contact the winners, but if the promoter is unable to contact any winner within 14 days of the closing date, the promoter may at its discretion disqualify that winner and choose an alternative winner at random from the remaining valid entries subject to the same terms and conditions.

6. Prize redemption and restrictions

6.1 Subject to 5.2 and 6.3 below, to claim their prizes, winners must reply to the email from the promoter.

6.2 Subject to 6.1 and 6.3, once the promoter has received the winner’s email reply, the prizes will be sent by email to the winners at the email address provided within 7 days.

6.3 If any winner does not claim the prize within 14 days from date of being notified of being a winner by the promoter, then promoter reserves the right to award the prize to another entrant chosen at random by computer from the remaining valid entries, in which case the first winner chosen will not be eligible for any share of the prize.

7. Data protection and publicity

7.1 Entrants’ personal data will be used in conformity with the Promoter’s Privacy Policy (available at https://app.tryflux.com/legal/privacy) and any consents entrants have given or subsequently give in accordance with that Privacy Policy.

7.2 By entering the prize draw, entrants understand that their personal details may be used for the purposes of administering the prize draw and awarding the prizes in accordance with the Privacy Policy.

7.3 By entering the prize draw, an entrant agrees that, subject to obtaining his or her valid consent, his or her personal details may also be used in accordance with the Privacy Policy for the purposes of receiving marketing materials regarding the promoter’s products and services that may be of interest from time to time. If you do not wish to receive marketing you should make this preference clear when asked for your consent. If in the future you wish to opt out of receiving any marketing materials from the promoter, you may either click on the unsubscribe link in any marketing communication itself, or contact the promoter directly using the contact details provided at the top of these terms and conditions.

7.4 Subject to the winner objecting as set out in paragraph 7.5:

7.4.1 each winner may be asked to post a tweet referencing the fact that they are a winner of this prize draw and mentioning the promoter, however this will not be a mandatory requirement and winners are not obliged to post such tweet; and

7.4.2 the promoter will make available on request information that indicates that a valid award took place.

7.5 The winners have the right to object to the use of their details in any publicity at the time of notification that they have won a prize.

8. Liability

8.1 The promoter accepts no liability for entries that are lost, delayed, misdirected, incomplete, illegible, corrupted, damaged in transit or cannot be delivered for any reason. Proof of submitting an entry is not proof of the promoter’s receipt.

8.2 The promoter accepts no liability for any costs associated with any prize.

8.3 The promoter gives no representations or warranties about the quality or suitability of any prize.

8.4 Except for liability for death and personal injury caused by the promoter’s negligence and any other liability which cannot be excluded by law, the promoter will not be liable for any loss, expense, liability or damage which is incurred (whether or not arising from negligence) in connection with entering this prize draw or accepting or using any prize.

8.5 The promoter will not be liable for any failure to comply with its obligations relating to the prize draw where that failure is caused by something outside its reasonable control (including but not limited to weather conditions, fire, industrial action, war, political unrest, riots or changes of law).

9. General

9.1 If events beyond the promoter’s reasonable control make this promotion or the awarding of any of the prize impossible, the promoter may in its discretion vary or amend the promotion accordingly including (but not limited to) substituting an alternative prize of equal or greater value and/or changing the closing date. If this does happen, the promoter will ensure that existing entrants are not adversely affected.

9.2 The promoter reserves the right to withdraw, suspend or amend this prize draw for reasons outside its reasonable control or any technical or other difficulties which might compromise its integrity, with no liability to any entrants.

9.3 The promoter’s decision on any aspect of this prize draw is final and binding and no correspondence will be entered into.

9.4 The prize draw may be promoted via a post on Flux’s social media channels. The prize draw is in no way sponsored, endorsed or administered by, or associated with, the social media platform itself (e.g. Twitter). Entrants acknowledge by entering the prize draw they are providing their information to the promoter and not to the social media platform.

9.5 Entrants must comply with all of the rules regarding the use of the social media platform including, but not limited to, any rules relating to the entry of prize draws, promotions or competitions either directly through the platform or otherwise.

9.6 By entering the prize draw, entrants release the relevant social media platforms from any action or claim arising out of the promotion. Any questions, comments or complaints regarding the promotion must be directed to the promoter and not to social media platform.

9.7 This prize draw and its terms are governed by English law and subject to the exclusive jurisdiction of the English courts.
