The 1851 Treaty of Ft. Laramie does give the Sioux tribe rights to the land through which the pipeline crosses. Even though this treaty has been frequently violated since its inception, it does not invalidate the tribal claim to protect this land. It is also true that trains spill more frequently, but pipelines can do much more damage when they do spill because of the volume of these spills. This would be more acceptable if there was assurance that of the safety of these pipelines, but the numerous spills in the past two years give us little confidence that this pipeline will hold up under this critical waterway.
