Terms of Service

Introduction

Welcome, these are the Terms and Conditions of Service (the “Terms”) for the website located at medium.com/@Vondateam (the “Site”), along with the mobile application known as Vonda (the “App”) (hereinafter, the Site and the App shall all be collectively referred to as “Vonda”). These Terms shall supplement our Privacy Policy (the “Policy”) incorporated herein by reference.

Vonda is proudly operated to you by Vonda Inc., hereinafter referred to as “Vonda”. The terms ‘us’, ‘its’, ‘ours’ and/or ‘we’, as used herein, refer to us, Vonda and/or our affiliates, assignees, successors and/or brands. As used herein, the terms ‘you’, ‘your’, and/or ‘yourself’ refer to you, a user/visitor/browser of our Vonda, whether registered under an account or not.

Acceptance

If you continue to browse and use Vonda, you hereby acknowledge and agree to be bound by and under these Terms which, together with our Policy, will govern Vonda’ relationship with you in relation to the Site and the App, along with any products and services offered thereby (collectively, the “Service(s)”).

You hereby acknowledge and agree that these Terms are concluded between you and Vonda only, and not with Google Inc. or Apple Inc. Henceforth, Vonda is solely responsible for the Site and the App and the content thereof. These Terms may not provide for usage rules for the App that are less restrictive than the usage rules set forth for licensed applications in, or otherwise be in conflict with, Google Inc.’s or Apple Inc.’s app stores terms of service.

Updates

Vonda reserves the right to modify, amend, suspend, terminate, upgrade, update or otherwise modify the Services, at any time and without notice. Any changes to these Terms will be displayed in the Site, and we may notify you through the App or by email. Please refer to the last effective date where changes were last undertaken by us. Your use of our Services after the effective date of any update– either by an account registration or simple use — thereby indicates your acceptance thereof.

Services

Vonda allows anonymous communication among our users via text, photo and video messages in a chat interface. You must open an account with us in order to use the App, though your user profile will be anonymous by default. Any chat messages you receive are not intended to purport any identifiable person. For example, if you receive a message in a chat from the username “jenny”, such chat message is not representing to be anyone, and you will not be able to infer the actual location, address, telephone or personal information of any user unless the user elects to disclose it to you.

The App is free to download and use, and we offer a free trial of our Services where you can receive chat messages. In order to use the full functionalities of Vonda, you can upgrade to a paid subscription. We offer two subscription tiers: (i) where you can send messages to other users; and (ii) where you can send and receive multimedia content. Your subscription will automatically renew until before the end of the then current monthly period. Your account will be charged for renewal within prior to the end of the current period.

You can elect to cancel your subscription at any time, by accessing your account in Google Inc.’s or Apple Inc.’s app stores and following the necessary steps. If can cancel your current subscription during the active period, and you will be able to use the paid functionalities of the App until the period ends. We do not offer refunds.

We will use third-party payment processors in order to bill you for any Services provided through Vonda. The processing of payments will be subject to the fees, terms, conditions and privacy policies of such payment processors. Vonda is not responsible for any and all fees, delays and errors by the payment processors.

Subscriptions

As our user, you agree to our subscription guidelines:

• To upgrade, simply select our Monthy Subscription packages

• Your subscription lasts 1 month, 3 months, 6 months and a year. It depends of what you choose.

• The pricing may change based on your country.

• Payment will be charged to your iTunes Account at confirmation of purchase.

• Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current subscription.

• Your account will be charged for a renewed subscription within 24 hours prior to the end of current subscription.

• You can manage your subscription and switch off the auto-renewal by accessing your account settings after purchase.

• You cannot cancel the current subscription during the active subscription period.

Prohibited Activities

As our user, you agree to not undertake, motivate, or facilitate the use or access of Vonda in order to:

• Infringe these Terms, or allow, encourage or facilitate others to do so.

• Plagiarize and/or infringe the intellectual property rights or privacy rights of any third party, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.

• Distribute, post or otherwise make available any content that: (i) infringes or endangers the intellectual property rights of any person (e.g. trademark, moral rights, trade secret, copyright, ancillary rights or other); (ii) enables any act that could promote or cause discrimination, racism, harm, libel, hatred or violence against any individual or group; (iii) endangers children and underage persons; (iv) is or allows illegal or fraudulent activities to take place; (v) is or may constitute a criminal or capital offense or otherwise infringes any applicable law; and/or (vi) is or can be considered to be obscene, threatening/defamatory, plagiarized, firearms, tobacco, alcohol, marijuana, gambling, binary options, Forex, pornographic or analogous material.

• Collect, receive, transfer or disseminate any personally identifiable information of any person without due consent from the title holder.

• Solicit money from other users.

• Ask other users to conceal the identity, source, or destination of any illegally gained money or products.

• Upload infringing, false, duplicated, altered or otherwise misleading purchase information.

• Use any automated or manual process to obtain, copy, process, access and/or use our Services or any part therefrom to capture unauthorized data or content, for any purpose.

• Enable, undertake, program or execute any type of system, computer program or technique in order to data-mine, retrieve, scrape, index or otherwise extract unauthorized information from Vonda or any portion or data feeds therefrom. For purposes of clarification, such actions will include the use of persons, site search/retrieval applications, software ‘robots’ and ‘spiders’ and any analogous data gathering and extraction tools, regardless of the type and amount of information intended for extraction.

• Use Vonda to disseminate any type of computer viruses, worms, defects, Trojan horses or other items of a destructive nature.

• Undertake any action that will or may cause an unreasonable load on Vonda’ and/or its partners’ and affiliates’ technology or infrastructure, or otherwise make excessive traffic demands from Vonda.

• Intercept or monitor activity via our Services without our express authorization.

• Otherwise reverse engineer, decompile or extract the proprietary code of Vonda.

• You also acknowledge and accept that any violation of the aforementioned provisions may result in the immediate termination of your access to Vonda and our Services, without refund or reimbursement on our part. Vonda may terminate or suspend your subscription and/or membership for our Service, at any time, for any reason, without prior notice, and at our sole and final discretion.

Parental Notice

Vonda does not provide its Services to persons under the age of eighteen (18). Users under the age of eighteen (18) may not use Vonda, even with the consent of their legal guardians. All of our users are otherwise prohibited from providing us with personally identifiable information of persons under the age of thirteen (13).

Ownership

The trademarks, copyright, service marks, trade names and other intellectual property rights and proprietary notices displayed on Vonda are the property of –or otherwise are licensed to Vonda or its licensors or affiliates, whether acknowledged (or not), and which are protected under intellectual and proprietary rights in the United States of America and other jurisdictions throughout the world. Respective title holders may or may not be affiliated with us or our affiliates, partners and advertisers. No section hereof shall be construed as intent to grant to you any right transfer or interest in Vonda or our Services, in whole or in part.

For ease of understanding, ‘intellectual property rights’ shall mean any and all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of the United States of America and other applicable jurisdictions.

You acknowledge and agree that any and all infringing use or exploitation of copyrighted content in Vonda and/or the Services may cause us, our affiliates, licensors or content providers irreparable injury, which may not be remedied solely at law, and therefore our affiliates, licensors or content providers may seek remedy for breach of these Terms, either in equity or through injunctive or other equitable relief.

You hereby acknowledge and agree that, in the event of any third party claim that the App infringes any third party’s intellectual property rights, Vonda, and not Google Inc. or Apple Inc., will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Licenses

User Generated Content License. You hereby grant Vonda an unlimited, non-exclusive, royalty-free, for all the world, right and license to download, use, reproduce, distribute, analyze and exploit any and all content, texts, data and any components therefrom that you or your affiliates, agents, employees or representatives introduce, upload or otherwise deliver to Vonda. You represent and warrant to Vonda that you have all rights, authorizations or otherwise hold sufficient title for all content submitted to Vonda as set forth herein.

Third party links

From time to time, the Site, the App and/or the Services may contain hyperlinks to other websites. These links are for your personal convenience and to provide you with further information which may be of interest to you. The provision of such links does not imply any endorsement of such third party websites (or their products and services).

From time to time, we may place ads and promotions from third party sources in the Site, the App and/or the Services. Accordingly, your participation or undertakings in promotions of third parties other than Vonda, and any terms, conditions, warranties or representations associated with such undertakings, are solely between you and such third party. Vonda is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third party advertisers.

User Privacy

By disclosing any information to us, you agree to the terms of our Policy, including the terms for the collection, process, storage and disclosure of such personally identifiable information, including to our affiliates, partners and clients. We will ask for your express consent, including for inclusion into our newsletters, updates, and follow ups. For more information, please read our Policy.

Digital Millennium Copyright Act (‘DMCA’) Notice

For DMCA Takedown Notices and alleged intellectual property rights infringement within Vonda, you can get in touch with us as indicated in our contact section. Under federal United States law, if you knowingly misrepresent that online material is infringing, you may be subject to criminal prosecution for perjury and civil penalties, including monetary damages, court costs, and attorney’s fees.

You must notify us of your claim with subject: “Takedown Request”. Once received, Vonda will study and consider your claim and, if it believes or has reason to believe any content on Vonda that infringes on another’s copyright, Vonda may delete it, disable or otherwise stop displaying it. Please note that this procedure is exclusively for notifying Vonda and its affiliates that your copyrighted material has been infringed.

Your DMCA notification claim must be in writing and must at least contain the following information: (i) your signature and identification, or the ones the person authorized to act on behalf of you or the title holder; (ii) a clear and concise description of the content of which its copyright has allegedly been infringed; (iii) contact information (e.g. address and email); and (iv) a statement, under penalty of perjury, indicating that you have a good faith belief that the information provided in your claim is true and accurate. The preceding requirements are intended to comply with Vonda’ rights and obligations under the DMCA, including 17 U.S.C. 512(c), but do not constitute legal advice.

No Warranty

Neither Vonda, nor its affiliates, subsidiaries, officers, employees and agents warrantee that Vonda will be error-free, uninterrupted, secure, or produce any particular results. No advice or information given by Vonda or its employees, affiliates, contractors and/or agents shall create a guarantee. Vonda has not been completely tested in all situations or devices, and that Vonda may or will contain operational malfunctions, errors, viruses, bugs, worms, trojan horses, bots and other harmful and destructive components or defects.

Neither Vonda nor its affiliates, licensors, owners, subsidiaries, brands or advertisers are a professional advisor in any industry. The functionalities and results displayed within Vonda may or will vary, without prior notice or without any notice at all, and you may receive messages and chat, or not, depending in the availability of other users and/or functionalities of Vonda, and any results will depend on a variety of factors out of the ultimate control of Vonda. Your use of any information and/or materials on Vonda is entirely at your own risk, for which we shall not be held liable.

To the fullest extent permissible under applicable law, Vonda is provided to you “as is”, with “all faults” and “as available”, with all faults, without warranty of any kind, without performance assurances or guarantees of any kind, and your use is at your sole risk. No oral or written advice provided by Vonda, its affiliates, clients, agents, officers, licensors, distributors and/or any authorized representative, shall create any implied warranty. The entire risk of satisfactory quality and performance resides with you. Vonda, and its affiliates, clients, agents, officers, licensors and/or distributors, do not make, and hereby disclaim, any and all express, implied or statutory warranties, either by statute, common law, custom, usage of trade, course of dealing or otherwise, however arising, including implied warranties of description, quality, fitness for a particular purpose, operation, integration, adequacy, suitability, title, non-infringement, non-interference with use and/or enjoyment.

Disclaimer of Damages

In no event shall Vonda, its affiliates, clients, agents, officers, licensors, distributors and/or any authorized third party, be held liable for any special, indirect, incidental or consequential damages, including losses, costs or expenses of any kind resulting from possession, access, use or malfunction of Vonda including but not limited to, loss of revenue, profits, business, loss of use or lack of availability of computer resources, lost or corrupt data, re-procurement amount, anticipated savings, wasted expenditure, or other commercial or economic loss; or for any indirect, incidental, special, punitive, aggravated, exemplary, or consequential damages whatsoever arising out of or related to Vonda whether arising in tort (including negligence), contract, strict liability or other legal or equitable theory and whether or not Vonda, its affiliates, clients, licensors and/or distributors have been advised of the possibility of such damages. For purposes of this limitation of liability, Vonda’ affiliates, licensors and distributors are third party beneficiaries to the limitations of liability specified herein and they may enforce these Terms against you.

Limitation of Liability

In no event, shall Vonda’, or its affiliates’, clients’, licensors’ and/or distributors’ liability for all damages (except as required by applicable law) exceed the amount of USD$50.00 (Fifty United States Dollars); and henceforth any award for direct, provable damages shall not to exceed such total amount. These Terms provide you specific legal rights, and you may have other rights that may vary from jurisdiction to jurisdiction. Legislation of some states/countries does not allow certain limitations of liability, and henceforth this limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. This limitation of liability shall not be applicable solely to the extent that any specific provision of this limitation of liability is prohibited by any federal, state, or municipal law, which cannot be pre-empted.

As our user, you hereby acknowledge and agree that Google Inc. and Apple Inc., and their affiliates and subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions hereof, they will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

Indemnification

You shall indemnify, hold harmless, and defend Vonda, its affiliates, clients, agents, officers, licensors, distributors and/or any authorized representatives, and the officers, directors and employees of each (jointly, the “Vonda’ Indemnitees”) from and against any and all third party liabilities, claims, causes of action, suits, losses, damages, fines, judgments, settlements and expenses (including any and all reasonable outside attorneys’ fees and court costs) which may be suffered, made or incurred by any of such Vonda’ Indemnitees arising out of or relating to: (i) any breach of any warranties, representations and/or covenants made by you hereunder (to the extent not arising substantially from any breach hereof by Vonda); and/or (ii) any third party claim arising out of or in relation to Vonda or use thereof in combination with your business platform, including without limitation, any claim that Vonda violates, infringes, or misappropriates any proprietary or intellectual property right of any third party, including without limitation, any privacy right of any person, or violates any applicable law.

Generals

Advertisements and Promotions. From time to time, we may place ads and promotions from third party sources in Vonda. Accordingly, your participation or undertakings in promotions of third parties other than Vonda, and any terms, conditions, warranties or representations associated with such undertakings, are solely between you and such third party. We are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third party advertisers on Vonda.

Assignment. These terms will inure to the benefit of any successors of the parties.

Content Moderation. Vonda hereby reserves the right, at its sole and final discretion, to review any and all content delivered into Vonda, and use moderators and/or any monitoring technology to flag and remove any user generated content or other content deemed inappropriate.

Equitable remedies: You hereby acknowledge and agree that if these Terms are not specifically enforced, Vonda will be irreparably damaged, and therefore you agree that Vonda shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to your breach of any of these Terms, in addition to any other available remedies.

Force Majeure. Vonda shall not liable for any failure of performance on its obligations as set forth herein, where such failure arises from any cause beyond Vonda’ reasonable control, including but not limiting to, electronic, power, mechanic or Internet failure.

No Embargo. You hereby represent and warrant that: (i) you are not located in a country that is subject to a U.S.A. government’s embargo, or that has been designated by the U.S.A. government as a “terrorist supporting” country; and (ii) you are not listed on any U.S.A. government list of prohibited or restricted parties or activities.

No Waiver. Failure by Vonda to enforce any rights hereunder shall not be construed as a waiver of any rights with respect to the subject matter hereof.

No Relationship. You and Vonda are independent contractors, and no agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by these Terms.

Product claims. You acknowledge and agree that Vonda, and, not Google Inc. or Apple Inc., is responsible for addressing any claims of you or any third party relating to the App in your use or possession, including, but not limited to: (i) product liability claims; (ii) any maintenance and support services; (iii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iv) claims arising under consumer protection or similar legislation.

Severability. If any provision of these Terms is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of these Terms will remain in full force and effect.

Waiver of Class Actions, Non-Individualized Relief. You acknowledge and accept that claims brought against Vonda shall be only on an individual basis and not as a plaintiff or class member in any possible future class or representative action or similar proceeding. Unless otherwise agreed by you and Vonda, you may not adjoin or consolidate any claim with more than one person’s; and you may not otherwise supervise or take over any form of a class, representative or consolidated proceeding.

Applicable Law. Your use of this Vonda and any cause of action, claim and/or dispute that might arise between the parties hereon, shall be subject to the laws of the State of Florida, United States of America, without regard to conflict of law principles.

Forum. You agree that any dispute arising from or relating to these Terms will be heard solely by a court or tribunal of competent jurisdiction in or nearest to the City of Fort Lauderdale, State of Florida, United States of America. If you bring a dispute in a manner other than in accordance with this section, you agree that we may move to have it dismissed, and that you will be responsible for our reasonable attorney’s fees, court costs, and disbursements in doing so. You agree that the unsuccessful party in any dispute arising from or relating to these Terms will be responsible for the reimbursement of the successful party’s reasonable attorney’s fees, court costs, and disbursements.

Waiver of Jury Trial. The parties herein waive their constitutional and statutory rights to go to court and have a trial in front of a judge or a jury, instead electing that all claims and disputes be resolved by a competent judge.

Privacy Policy

Introduction

Welcome, this is the Privacy Policy (the “Policy”) for the mobile application known as Vonda (the “App”), the website located at medium.com/@Vondateam (the “Site”), including its sub-domains and mobile optimized versions, collectively hereinafter referred to as “Vonda”. The Site is provided to you by Vonda Inc., hereinafter referred to as “Vonda” and as “our”, “us” and “we”. Overall, this Policy is a legally binding agreement between Vonda, and you, an end user of our products and services offered via the Site and the App, and referred herein as “you”, “your(s)” or “yourself”).

This Policy shall also include our Terms and Conditions and any supplemental guidelines and policies provided by us from time to time, all incorporated herein by reference.

You can rest assured that we will never spam your inbox, provide unsolicited offers or otherwise disclose your personally identifiable information (the “PI”) to any third party, unless we have your prior express consent. Here at Vonda, we work hard to earn and keep your trust; and therefore we adhere to the following principles in order to protect your privacy:

• We will not sell or lease your PI to third parties.

• We will not disclose your PI with other users or third parties without your consent.

• Any PI that you provide to Vonda will be secured with industry standard safety protocols and technology.

As used herein and elsewhere, the words “collect”, “use”, “process”, “treat”, “disclose” and analogous shall be related to your PI and other data that we may receive from our clients, users and/or visitors, including cookies inside a computer and mobile device IDs.

Information Collected

In order to use Vonda, you may need to disclose certain PI to us, including but not limited to: your name, last name, mobile phone number, IP address, email, mobile device ID, photo gallery, camera, microphone, mobile device type, browser type, language and/or operating system used. In addition, we offer certain payment functionalities, which require that certain third party payment processing platforms collect sensitive financial information of our users (e.g. credit card and payment information).

If you do not wish to disclose any or part of your PI to us, you may still be able to use some of the functionalities of Vonda, though we will not be able to guarantee that you will be able to enjoy our products, services and benefits if you elect not to disclose it to us. Overall, your final remedies will be to close this web tab, delete your account with us, and/or exit Vonda.

Purpose and Process of the Collected Information

In order for us to offer our products and provide our services, we will need to undertake the storage, use, combination, integration, disclosure, and process of your PI; including, in case, the transfer to our affiliates and other authorized third parties. By storing your PI on our secure servers, we are able to shorten your login process and allow you to modify your personal profile online. We will generally collect, use and disclose your PI to:

• Send recommendations about your browsing preferences.

• Verify your e-mail address; send password retrieval links and other account notices.

• Improve your user experience and provide you with personalized support

• Develop, research, process, safeguard and improve our services.

• Answer to queries and suggestions you submit to us.

• Improve your user experience, offer newsletters, offer promotions, send service related announcements and contact you about inquiries for our services.

Vonda may offer the functionality of using your social media and other third party credentials (e.g. Facebook and Google) to execute single-sign-on, and in that manner we will also collect your PI as provided to us by such third party platforms; such as your photos, info of your social media contacts and their common contacts, login data and profile information such as “about me”, “friend lists” and “interests”. We will not collect more information when using such credentials beyond the PI such third parties generally disclose to us via their services. For more information, please refer to the terms and policies of such platforms.

Control of your information

As our user, you will generally be able to control and select the amount and type of PI you may disclose to us when using Vonda. We continuously try to improve our user experience, and stride to provide you the best choices for the disclosure, edition or removal of the PI being processed by us. Accordingly, we will undertake the open and transparent management of your PI and will: (i) inform you about how your personal information may be used and disclosed (including overseas); (ii) maintain the safety and integrity of your personal information; and/or (iii) enforce your individual right to access and correct your personal information.

In order to enforce of your privacy rights, please contact us as indicated in the contact section of the Site. Your privacy request must include, at the least, the following information: (i) your complete name, address and/or e-mail address in order for us to notify you the response to your request; (ii) attached documents establishing your identity; and (iii) a clear and concise description of the PI with regard to which you seek to enforce any of your privacy rights. If you request rectification, please indicate amendments to be made and attach documentation to back up your request.

Upon receipt of your privacy request, and after due review, we may then edit, deactivate and/or delete your PI from our Site. Please take into account that we may not be able to delete all of your data from our secure databases or the databases of third parties to which your PI has already been disclosed. If that is the case, please contact such third parties directly in order to request enforcement of your privacy rights. In case of secure databases under our control where deletion becomes impossible, we will make such information inaccessible.

Safety of your information

We use industry standard protocols and technology to protect your registered user information and PI, such as Secure Socket Layer (SSL) technology and secure databases. Your PI is only accessible by a limited number of our employees who have special access rights. Overall, we implement and maintain reasonable security measures to protect our databases and records from unauthorized access, acquisition, destruction, use, modification or disclosure. However, please take into account that the Internet and related transmissions are not secure or error free communication means.

Additionally, if you post information on a public forum, message board, blog or bulletin board, any PI you elect to disclose therein there may or will be read, collected and/or used by other users of such forums and could be used by third parties to send you unsolicited messages.

Parental Notice

Through the simple use of Vonda, you hereby represent and warrant that you are at least eighteen (18) years of age — or older — as of the date of first access thereof. If you are still a minor (which may depend on the jurisdiction where you reside), you cannot access or use Vonda, even under the direct supervision of your parent or legal guardian. Vonda does not knowingly collect any kind of information from persons under the age of thirteen (13), and will promptly delete any related information or account.

Information release and disclosure

We must reserve our right to disclose your PI when we or our affiliates, clients, contractors, licensors, officers, agents and/or representatives reasonably believe it necessary to protect our interests, or where you result to be in breach of our Terms and Conditions and/or this Policy. Accordingly, we will have the right to disclose any and all collected PI and/or data, under the following circumstances:

• If required under applicable law, rules or regulations.

• In response to a valid request or subpoena from a government or law enforcement agency.

• To defend ourselves and our affiliates, licensors, officers, agents and representatives from legal claims and processes brought to us by third parties (including takedown notices).

• To defend the property, rights and integrity of any of our users, advertisers or licensors.

• To stop or cause to cease any actions that we may consider to cause –whether allegedly or factually– a contingency or liability.

We may also share non-personal information with third parties, such as aggregate user statistics, demographic information, and web site usage information.

Newsletters and Commercial Messages

From time to time, we will ask you for express permission and consent to receive Commercial Electronic Messages (‘CEM’). A CEM is a message in an electronic format (e.g. email, SMS, push notifications and other form of communications) which is then sent to an electronic address (e.g. email, mobile device) and that contains a message asking recipients to participate in commercial activities (e.g. purchase of products, services and invitations to participate in user research).

Our optional email newsletters are considered CEMs, and therefore you may subscribe or unsubscribe from them at will, usually on your account settings, or by following the unsubscribe links contained therein.

Cookies and beacons

From time to time, we may place the so-called ‘cookies’ in your computer in order to track and collect data regarding your use of our Site. Cookies are small text files that our Site transfers to you and that allow us permit us to recognize you and obtain data such as how, when and how long you browse pages in our Site. We also use the so-called ‘beacons’, which are small files, sometimes only a pixel in size, embedded onto the pages of our Site. We may also collect and use the data contained in log files, which may include your IP (internet protocol) address, your ISP (internet service provider), the browser you used to visit our site, the time you visited our Site and which pages you visited throughout our Site.

Third party sites and services

Vonda may display hyperlinks to the websites of our commercial partners and other third parties. If you click on such links, you are choosing to visit such websites, and will be redirected there. Please take into consideration that we are not responsible for the privacy and personal data practices undertook by such third parties (including any tools, cookies, information or content contained thereunto), and that we do not have control over the manner in which such third-parties may collect, process, treat or use your PI.

When you use such links to go to another website, our Policy is no longer into effect and your browsing thereof is in your own and final risk. In addition, any banner or ad that we may display on Vonda does not constitute any endorsement of any third party thereof.

Advertising, opt-out

From time to time, we may use Google Analytics, Ad Words, Double Click and/or Ad Sense tracking codes, and other third party software tools (such as remarketing codes) in order to collect information and marketing analytics about the manner in which you browse our Site. These ads served will be targeted based on your previous browsing history, and may include retargeting codes. For example, third party vendors may show you Vonda’ ads on certain websites across the Internet, even after you leave our Site. The collected information is anonymized, meaning it cannot be tracked back to individuals. Using such tools, we learn how to optimize, and serve ads based on a user’s past visits, providing you with a better user experience.

Our third party vendors may also use cookies and beacons to track your Internet browsing in order to serve you ads based on what they or us believe to be of interest according to your browsing activities and consumer preferences. Henceforth, by using this Site, you consent to such disclosure, treatment and storage of PI.

In order to enforce and uphold your right to privacy, you have the option to elect not to receive this type of advertising from us or third parties, now or in the future. Payment processors

We use third-party payment processors to manage any transactions undertook through Vonda. The processing of payments will be subject to the fees, terms, conditions and privacy policies of such payment processors. Vonda is not responsible for any and all errors by the payment processors.

International disclosure

Upon the case where Vonda specifically undertakes the process of personal data that has been duly disclosed by you to us, and that is subject to national legislation that implements the EU Data Protection Directive (95/46/EC), by clicking the “I Accept” button or otherwise accepting the terms and conditions of our services through a clickable action or similar action, you hereby acknowledge, agree and accept to such transfer.

California Online Privacy Protection Act

In compliance with CalOPPA, we have hereby posted this conspicuous Policy to the public, indicating the PI being collected and the manner in which it may be disclosed and with whom. Accordingly, our users can may visit our Site using anonymous browsing, this Policy linked in our home page, with the link including the word ‘Privacy’ or similar. We also comply with Policy changes notification to our users, and provide mechanisms that allow our users to manage their PI personal information.

Amendments, Updates

We reserve the right to amend, change, suspend and/or update Vonda, our services, this Policy and/or our Terms and Conditions, in whole or in part, from time to time and at our sole and final discretion. Your continued use thereof after the last effective date of modifications thereof indicates your acceptance of such modifications. We will post any updates on Vonda, and may also send you an email or otherwise notify you of any material changes to this Policy.
