Some question the basis for separation of church and state. Wikipedia says that “Separation of church and state” is a phrase used by Thomas Jefferson and others expressing an understanding of the intent and function of the Establishment Clause and Free Exercise Clause of the First Amendment to the Constitution of the United States. The first amendment to the US Constitution states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof” The two parts, known as the “establishment clause” and the “free exercise clause” respectively, create the textual basis for the Supreme Court’s interpretations of the “separation of church and state” doctrine.

This federal appeals court’s decision in Lund v. Rowan County does seem to violate separation of church and state.
