A Jury Needs to Sort This Out
The typical 13-year-old is not stupid or panicky enough to try and scare off a group of (real-)gun-welding police officers with a BB gun. It’s hard to see how any ethical prosecutor could not see probable cause to indict the police officers who fired on this child.
