This is I believe the root of the issue. The problem with Facebook’s PATENTS addition is not so much the direct effects Daniel is dismissing as minimal, but rather the expression of the belief of Facebook’s attorneys that there is no patent license implied by BSD-3. That triggers a bunch of FLOSS lawyers (who also provoked controversy around CC0 at OSI) who believe Facebook is messing with the balance of paower in the patent cold war, and they in turn trigger their developer staff who work at Apache.
