If you have been involved in a car accident with an uninsured at-fault driver don’t worry, you are not alone. Accidents where the at-fault driver is uninsured happen every day.

In fact, according to a 2017 study by the Insurance Research Council (IRC) approximately 1 in 8 drivers (or 13%) were uninsured in 2015. According to the IRC around 9.4% of drivers in South Carolina are uninsured.

If you are hit by an uninsured motorist or involved in a hit-and-run accident, uninsured motorist coverage can help protect you. Uninsured motorist coverage can help cover the policyholder and riders in the vehicle if injuries occur during the accident.

South Carolina law requires drivers to have Uninsured Motorist coverage at the minimum policy limits (25k/50k/25k).

This means that if you have car insurance in South Carolina you at least have Uninsured Motorist Coverage of 25/50/25.

As mentioned above, this Uninsured Motorist Coverage can be used to protect you and individuals in your covered vehicle if you were involved in an accident with an at-fault driver who does not have insurance.

After an accident it is important to gather whether an insured has insurance. A police officer in South Carolina will complete report of the accident, typically called a form (FR-10), which lays out who has what insurance company.

If you were injured in a car wreck it is important to talk with a lawyer about navigating your potential injury claim, especially if the at-fault driver is uninsured.
