Shaping US AI Cybersecurity Regulations in 2024

On October 30th 2023, the White House issued an executive order concerning Artificial Intelligence (AI) and cybersecurity, marking a significant milestone in addressing these critical areas.

Executive orders like this often set the stage for subsequent regulatory actions. This directive underscores the government’s acknowledgment of the pressing need to establish robust measures governing the utilization of AI in cybersecurity. As history has demonstrated, such executive orders typically kickstart regulatory processes that shape the future of AI and cybersecurity governance, ensuring the protection of vital systems and infrastructure against evolving threats.

It is imperative that Enterprises remain informed about the timeline for proposed regulations, and to prepare adequately for compliance. Understanding the regulatory process enables enterprises to engage effectively, providing comments and feedback during the rulemaking period. Having a robust plan in place ensures timely compliance with new requirements, minimizing disruptions to operations while upholding the necessary security standards.

We highly recommend regularly monitoring the government’s official website for updates on legislation regarding Artificial Intelligence (AI) progress.

Additionally, establishing close cooperation with industry and trade groups is essential. By actively engaging with these organizations, we can collectively assess the impact of emerging regulations on our enterprise and collaborate on formulating appropriate responses. This proactive approach will enable us to navigate regulatory challenges effectively and adapt our strategies to align with evolving legal frameworks surrounding AI.

Artificial Intelligence (AI) is also at the forefront of legislative agendas in many states. Emerging regulations are being drafted to govern the development, deployment, and utilization of AI technologies. These legislative efforts aim to address a spectrum of concerns ranging from privacy and security to fairness, accountability, transparency, and ethical considerations associated with AI applications.

Having a proper regulatory response is critical. All too often not getting ahead of regulatory developments means that a company will adopt new technologies later than others. It is not a realistic response simply to tell your employees that they cannot use ChatGPT, one of the biggest drivers of industrial growth today.

With Executive Orders being issued frequently, it’s imperative to establish a regulatory response function. Failing to do so raises the question: How will your organization effectively manage future Executive Orders? A proper regulatory response function requires the ability to also track a significant set of regulations from the 50 states and 5 territories.

Regulations shouldn’t be viewed solely as obstacles; rather, they can present valuable opportunities for growth and innovation.
