Pity, the article started really good, but apart from lamenting over the sad destiny of a “small” company named Uber, you haven’t given a single argument against the ruling of the court — the examples you have given are either unrelated (the awful racial laws of the past) or plain wrong (Internet existed way before telecoms started using it for VoIP, and it was the major telecoms that supported its use, albeit not for the end users, but for the internal architecture of their systems. And then, several startups just connected the dots and provided VoIP to the end users. The rest is history).
