The evolution of the justice system

In Aperiomics the police and justice system evolved by compromises between the center left and the center right. These interactions are mainly between three color codes.

The first is called Orange which represents neutrality, it is where Orange-Yellow people on the center-right in politics compromise with the Red-Orange center-left. These color codes also apply to the animal kingdom and its evolution. The Orange-Yellow or oY animals are loner predators such as the fox.

In the media they are approximately represented by FOX News, this is not meant to disparage them. They take a stance that fits into the color codes here. In Nature foxes hunt by deception, they succeed mainly by tricking their prey.

In politics this dynamic has historically been called Knaves versus Fools, the Knaves rely on trickery to make money from Fools. This leads to a pattern of lying and exaggeration as seen on FOX and with Trump. In Aperiomics there is nothing wrong with this, each side has evolved to use tactics that allow it to survive and evolve. Each needs the other, the animal kingdom could not survive without predators or prey.

The prey here are Ro or Red-Orange, they represent the herds in the animal kingdom. While often more gullible than the oY predators, they counter this deception by being open and honest with each other to avoid being fooled.

In a sense they counter deception with the rapid dissemination of factual information. This gullibility is needed to maintain a communal store of information. If they were continually suspicious of each other then the herd would tend to fragment into Red.

A herd will respond to finding oY predators by making noises and moving to warn the others. This altruistic behavior allows the herd to survive and so these tactics are an evolutionary advantage. The herd can also protect the young, old, and sicker animals by putting them in the center. The outside is policed by the stronger animals, much like a neighborhood watch or local gangs in society. Most Ro communities do the same, they share information to keep oY criminals away from their most vulnerable members.

Kropotkin referred to this altruism as a partial refutation of Darwin’s theory of evolution. Animals need not subject themselves to survival of the fittest, instead they survive by defeating predators with communal behavior. In society Ro leads to the welfare state, the herd-like community protects the young, the aged, and the sick from predators such as criminals and tricksters like con men.

This viable defense causes the oY predators to become more domesticated, the wolves for example evolved into dogs which helped to protect the Ro herd from their former ancestors. In society the Knaves find they succeed less often against the Fools, this is because the Ro members warn each other about the latest trickery.

As a result the Knaves become domesticated into agents and salespeople, they feed on commissions in a similar way to they did from a con. The nature of their sales pitches are restricted to reduce trickery and fraud. There is still some Caveat Emptor, or Buyer Beware, but this often leads to a compromise between the center-left and center-right in politics and society.

From this evolved Orange which in earlier times was the shepherd, they fed some oY wolves to domesticate them. In return the wolves would get some food more regularly, and in exchange would warn the Orange or O shepherd and the Ro herd against attacks from these predators. Over time they became more like guard dogs which could challenge the oY wolves.

In society the role of the shepherd evolved into the Orange police and justice system. In return for being supported by the Ro community, they used snitches and reformed criminals to control the Knaves in society. Some oY knaves became part of this Orange justice system, according to the saying it takes a thief to catch a thief.

The Orange center as absolute neutrality is unstable, it can swing to where the Ro herd dominates the laws. This is where freedom to do business can be stifled. An example of this is the joke: Why are Fools and their money soon parted? The answer is if they were not soon parted then no one would be doing any business.

When a society is too truthful to protect the vulnerable, this can lead to stagnation. Businesses find it nearly impossible to hide enough information to make sales. The oY Knaves can then revert to being criminals again as the accepted methods of sophistry and persuasion are too restricted. This was seen in Ro communist societies where corruption was used by Oy instead of being capitalists.

Another example of this is in the 70s where unionized companies made it too difficult to make profits, resulting in high unemployment. There was also high inflation as the unions, by saying they were protecting the vulnerable workers, kept wages rising to chase price increases. It led to the oY knaves controlling unions as part of organized crime, similar to in communist countries.

When society moves too far to the right then the oY side of the Orange police becomes stronger. Petty criminals have a freer hand, companies committing fraud such as before the Global Financial Crisis get away with much more. In that case the herd was systemically deceived about interest rates and liar loans.

The Ro community’s trusting behavior stemmed from a previous history of being protected from predatory banks. This stemmed from the Great Depression where the fraud from oY knaves collapsed the stock market. Ro society becomes less open as oY trickery is less challenged, deceptions become harder to expose. This is seen more recently with fake narratives being promoted through blogs on the internet by oY knaves.

The result tends to be the pendulum swinging from the left to the right, and back again. When the oY predators are too successful they overeat their prey. Then they can starve until the herd replenishes itself. If the Ro herd does too well then they can overeat in their environment, for example sheep eating too much grass.

Then they can become weaker until the oY predators attack more successfully. They can in turn overeat as the cycle moves between left and right, this happens in the animal kingdom and in society.

In society then the domination of the center-right oY leads to excess deception and fraud. This causes the Ro community to become increasingly confused, the signals between them are more mistrusted. Then they can be directed into still more predatory frauds. This tends to end when the Ro community is financially exhausted, the predatory banks decimated many communities leading to foreclosures and a Great Recession around the world.

There are two other color codes in these interactions, Red and Yellow. Red represents prey that survive like the oY predators so, with deception. They can hide and run quickly, scattering rather than staying in a herd. They represent the weaker elements in society such as children, the aged, and the sick. They are also people who tend to be individuals and libertarians, they don’t want to be controlled by a Ro herd mentality.

These are the main target of the oY predators, they are easier to overcome because the herd like the welfare state is not defending them. They can also be hard to catch because they have learned to be deceptive, with Knaves as salespeople the Red prey would defend themselves by hiding or lying. The herd defends itself against deceptive salespeople by sharing information to expose their trickery.

The Yellow color represents predators that move in a herd or pack. An example of this is wolves hunting together, or a pride of lions. They seek to counter the herd’s tactics by sharing predatory information.

The battle between Yellow and Red-Orange has little trickery, the Ro herd and the oY pack have good information about each other. They also tend to trust their respective packs and herds, they don’t use deceptive tactics such as camouflage and hiding to improve their cohesion. The battle proceeds as a war of attrition, the pack tries to wear down some of the herd’s members to feed.

In society Yellow is represented by some gangs, mafias, organized crime, and often predatory businesses. These can have a loose relationship with the oY deceptive predators, for example hyenas might hunt as Yellow packs and share a carcass with a lone oY lion.

A company might use its organization to build and distribute goods as Yellow. To do this is needs the cohesion of honesty in between its members, deception only weakens this cooperation between them. Instead it can use oY deceptive agents and salespeople to trick some Ro consumers into buying their goods. The Ro community defends itself against such companies by sharing information, and trying to avoid being worn down.

Yellow and Red-Orange then use the same kinds of honest organizations to share information. Yellow does this to prey on the Ro herd, Ro does this to wear out the Yellow pack.

For example in the leadup to the Global Financial Crisis the predatory Yellow banks were pillaging Ro communities by using deceptive oY agents. This kept the predatory loans more hidden so the Orange justice system was late in responding. The Ro community was slow to alert their members to these frauds, they assumed the Orange police were protecting them.

The Orange justice system maintains some balance by reducing the power of the Yellow organized predators. For example they might turn oY petty criminals and lower members of a mafia against their pack mentality.

As the Yellow companies and mafias become suspicious of each other, then their communal system fragments. This can reduce them to oY loner predators which are more easily controlled.

Yellow packs use the same tactics to break up Ro herd, to make them suspicious of each other. They begin to think there are many oY wolves in Ro sheep’s clothing, that fragments the Ro herd and community's cohesion so they can defend themselves less.

These attack on Yellow packs by the Orange justice system has a moderating effect on organized crime and business. To avoid oY whistleblowers in their organizations they moderate their predatory behavior. That allows them to maintain their pack structure.

The Red people are also moderated because their loner behavior can fragment the herd. If too many people use deception then the herd loses its ability to share information against predators. This is like the oY Knaves fragmenting the Yellow organizations.

Both then need to keep out deception and hiding out of their communities, to do this they impose a form of socialist discipline. This is where the community or society as a whole coerces individuals to be part of this social or socialist way of organization. That happens on the left with Ro and the Right with Y or Yellow.

A community needs people to share information to avoid the tricksters. The Orange justice system then tries to police this deceptive behavior by Red people in a similar way to with oY knaves.

Both the Red-Orange and Yellow communal organizations, as well as the Red and Orange-Yellow individualist tactics are essential in nature as well as in societies. Neither is better than the other, the system becomes less efficient when either is suppressed.
