Tom Palmer summarizes the dividing line between libertarianism and other political theories well when he says “It is the notion of authority that forms the true locus of the dispute between libertarianism and other political philosophies.” The libertarian mindset of the government is there to protect liberties, not to take them away. The government is allowed to favor one conviction or liberty to the neglect and the obstruction of other liberties of other individuals. This is why most legislation is illegitimate in a libertarian society. Which explains why libertarians are limited government. Most legislation violates the rights of others whether on the conservative side of the spectrum or the liberal side of the spectrum. When legislation is passed in favor of one party over the others, then the other parties will be offended.

One might object that the government’s sole purpose is to pass legislation that governs morality, but to govern morality doesn’t mean to favor one particular conviction over others. To govern morality ought to mean protecting people’s belongings, namely their body and their property. The only morality of the government in a libertarian society does not harm other people by taking from them, neither their wealth nor their health. People can take other people’s wealth by stealing from them and people can take someone’s health by harming them. So in this sense, the government is regulating morality. Anything more than this is excessive and subjective.
