Introduction to International Water Law

Course Overview

Water is a complex area of law that often states, governments, and nations find difficult to interpret. Topics such as water conservation, policy, management, trade and investment, and the human right to water have been brought before courts and other judicial bodies for guidance. The cases that have been argued and decided, at both the domestic and national level, are used as the basis for developing a framework for international water law. In this course, you will explore the basic principles, doctrines, and case studies used by water lawyers, scholars, policy makers, and practitioners to interpret the complexities surrounding water.

Course Learning Outcomes

At the conclusion of this course, participants will be able to:

  • Identify the basic principles of international water law.
  • Recognize the domestic approaches of water law that are commonly used and have served as the foundation for international water law.
  • Interpret the binding and non-binding principles of customary international law and how those principles relate to trade and investment.
  • Outline the treaties and conventions that act as exemplars to international water law.
  • Evaluate the positive and negative red, green, and blue approaches to international water law and public health.
