We Say NO Asylum Ban: BLMP Statement on Biden’s Latest Attack on Black Migrants

The Black LGBTQIA+ Migrant Project (BLMP) fully denounces the most recent attack on Black migrants by the Biden administration.
We are dismayed but certainly not shocked at the federal policy proposal, released Tuesday by the Biden administration. This proposal works actively to continue the unlawful shut out and detainment of Black migrants seeking refuge inside the United States. If enacted, it would have seismic effects on an already cruel, crumbling and illegitimate immigration system.
The rule proposes that migrants must first seek and be denied protection in any countries they pass through to be able to claim asylum once at a U.S. port of entry. The proposed rule would also make migrants ineligible for asylum if they do not have an ‘appointment’ at a US port of entry or utilized ‘humanitarian programs’ available to certain ‘nationalities’.
We have seen this before with the Trump administration’s inhumane attempt to enact a ‘transit ban’ for migrants seeking refuge- which was struck down in federal court. People fleeing for their lives have every legal right to seek safety within the United States.
This proposal is not only inhumane and unjust; it is unconstitutional and it is illegal. It is a violation of both federal and international law and diminishes any hope we had in this federal administration to fulfill their mandate and allow Black migrants to safely and justly seek protection in this country.
“ We are not surprised that President Biden, the former Vice President of President Obama the “Deporter in Chief” — who deported hundreds of thousands of immigrants and continually failed to follow through on his promises to strengthen protections for those seeking asylum and create pathways for immigrants to thrive, has once again disposed of those in our community who are most vulnerable. Asylum seekers, and more specifically Black LGBTQIA+ migrants, are seeking refuge from imperialist policies and practices forced on them in their home countries by western nations like the United States of America. This new restriction on asylum will not stop people from seeking asylum and it will not address the needs of the people at the border.”

As the U.S. invites and welcomes in tens of thousands of Ukrainian migrants with open arms, we can be certain this proposal, if enacted, will further the United State’s discriminatory practices against Black, migrants seeking safety and refuge, especially those who are queer, disabled, and poor. Black queer and trans migrants and the most vulnerable among us will no doubt face the brunt of the failings of this inhumane policy.
This policy proposal is clearly an attack on Black migrants. It is an attack on Black, queer, and trans migrants and it is an attack on us all.
This announcement comes on the tail end of Biden’s attempts to expand Title 42 in January, the failed launch of the CBP One App- which does not translate into Haitian Creole among other dialects, as well as the problematic Parole Program for Haitian, Venezuelan, Cuban, and Nicaraguan migrants.
The Trump administration implemented a racist web of policies, including Title 42 and the Migrant Protection Protocols (MPP), among many others- that effectively closed the Southern Border to migrants and further embroiled the U.S. immigration system further into chaos, and suffering. Black queer and trans migrants have been disproportionately impacted by Title 42 and are much more likely to be criminalized and deported — facing inhumane, violent treatment at our border.
The expansion of harmful Trump-era policies falls squarely on the Biden administration. These are no longer just ‘Trump policies,’ these are ‘Biden policies,’ where this administration bears full responsibility for the suffering they’ve inflicted on thousands of people and their loved ones.
Biden positioned himself as a clear counterpoint to Trump’s cruelty but instead, the Biden administration is carrying on like business as usual, breaking promises and tearing apart communities.

Sanctions, hybrid wars, occupations, coups, and economic colonialism force people out of their homes and into dangerous migration journeys. This 153-page document that feigns to care for the wellbeing of migrants fails to point to how the US continues to destabilize the countries people are migrating from.”

Immigration detention as a whole is unnecessary, rife with systemic abuses and completely arbitrary. Whether run by a local government, by ICE, or by a corporation, detention centers are rampant with systematic abuses and medical neglect. In just two years, the Biden administration has quadrupled the number of people enrolled in ICE’s so-called “alternatives to detention” (ATD) program, and has doubled the number of people in detention. This is unacceptable.
The United States dares to play moral authority or position itself as a beacon of democracy as they wage war on the world, and attempt to occupy and dominate all expressions of autonomous life and spirit. The false borders of the western world continue to control the natural and progressive movement of people as well as the forced migrations of the millions of refugees, migrants, and asylees of the world.
For generations, the US, and other imperial powers, have created and exacerbated the conditions which force the migration of Black people globally. Given the centuries of intentional harm it has done to Black communities across the globe, The U.S. has a fiscal, legal, and ethical responsibility to provide refuge for migrants, asylum seekers, and victims of their never -ending conquest of our cultures and lands, particularly for those who are Black or Brown, poor and/or disabled, queer and/or trans.
BLMP envisions a world without borders, rendering the word “ immigrant” obsolete. We will continue fulfilling our mandate to build power, community, and knowledge in the U.S. while challenging the role that the United States plays globally in creating the conditions that force us to leave our homes in the first place.
We continue to dream of a world where all Black people and our loved ones have housing, bodily autonomy, health, and the ability to move and travel freely, with dignity, free of criminalization, anti-Black racism, misogyny, and all forms of transphobia and homophobia.
Our liberation is bound up with one another, let us rise up and resist for our humanity, our dignity, and our Earth.

What is new about this moment is a renaissance, an awakening of the masses to the injustices that Black people have always faced on colonized land, but are more overt than they’ve ever been. The question is, how will the masses show up in this moment, to protect and defend those of us fighting for humanitarian protections that are our birthright? We can decry and denounce injustice but we cannot stop there. El Proyecto Migrante Negre LGBTQIA+ (BLMP, por sus siglas en inglés) denuncia vehementemente el más reciente ataque de la administración del presidente Biden en contra de inmigrantes negres.
Nos encontramos en total consternación pero no sorprendides por la propuesta federal, anunciada el martes por la administración del presidente Biden. Esta propuesta activamente perpetúa el continuo rechazo y detención de migrantes Negres buscando refugio dentro de los EEUU. De ser establecido, tendrá efectos trascendentales en un sistema de inmigración actualmente cruel, decadente e ilegítimo.
El reglamento propone que les migrantes deberán primeramente solicitar protección y ser rechazades en cualquiera de los países que crucen para entonces poder reclamar asilo una vez lleguen al puerto de entrada de los EEUU. El reglamento propuesto también hará que les inmigrantes sean no elegibles a recibir asilo de no poseer una ‘cita’ en el puerto de de los EEUU o que utilicen ‘los programas humanitarios’ disponibles para ciertas ‘nacionalidades’.
Esto ya lo presenciamos con los intentos inhumanos de la administración del presidente Trum al intentar establecer una ‘prohibición para migrantes que buscan refugio’ — el cual fue eliminado en la corte federal. Las personas que huyen por sus vidas tienen todo el derecho legal de buscar refugio dentro de los EEUU.
Esta propuesta no sólo es inhumana e injusta, es además inconstitucional e ilegal. Es una violación de leyes federales e internacionales y una cachetada en la cara a cualquier esperanza que tuviesemos en que esta administración federal cumpliera con su mandato de promesa.

Mientras que los EEUU invita y acoge a decenas de miles de inmigrantes Ucranianes con los brazos abiertos, podemos estar segures que esta propuesta, de ser establecida, extenderá aún más las prácticas discriminatorias en contra de negres, migrantes que buscan seguridad y refugio, en especial quienes son cuirs, discapacitades y pobres. Migrantes negres cuirs y trans y les más vulnerables entre nosotres enfrentarán sin duda alguna el embate de los resultados de esta inhumana política.
Esta política propuesta es un claro ataque a les migrantes Negres. Es un ataque en contra de migrantes negres, cuirs y trans y es un ataque a todes nosotres.
Este anuncio surge como fin de la lista de intentos de la administración Biden de expandir Título 42 en enero pasado, el fallido lanzamiento de el CBP One App — el cual no puede ser traducido al Creole haitiano entre muchos otros dialectos, a la vez que el problemático Programa de Parol para haitianes, venezolanez, cubanes,y nicaraguencxs.
La administración de Trump implementó una red de políticas racistas, incluyendo Título 42 y los Protocolos de Protección de MIgrantes (MMP, por sus siglas en inglés), entre otras cosas — que cerraron eficazmente la Frontera Sureña a migrantes y enmarañar en aún más caos y sufrimiento el sistema migratorios de los EEUU. Migrantes negres cuirs y trans han sido desproporcionadamente inpactades por el Título 42 y están más propensos a ser criminalizades y deportades — enfrentando un trato violento e inhumano en nuestras fronteras.
La expansión de las dañinas políticas de la era Trumpista y honestamente han continuado durante la administración del presidente Biden. Estas ya no son simples ‘políticas de Trump’, estas son ‘políticas de Biden’, donde esta administración carga la responsabilidad completa por el sufrimiento infligido a miles de personas y a sus seres querides. Biden se posicionó como una claro contrapunto a la crueldad de Trump pero a su vez, la administración de Biden ha continuado como es usual, rompiendo sus promesas y destruyendo comunidades.

Las detenciones por inmigración son en su totalidad innecesarias, llenas de abuso sistemático y completamente arbitrarios. Ya sea manejado por gobiernos locales, por ICE, o por alguna corporación, en los centros de detención el abuso sistemático y negligencia médica es rampante. En solo dos años, la administración del presidente Biden ha cuadriplicado el número de personas registradas en los llamados programas “alternos a detención” de ICE (ADT por sus siglas en inglés) y ha duplicado el número de personas detenidas. Esto es inaceptable.
Los EEUU se atreven a jugar el papel de autoridad moral o se posicionan como un ejemplo de democracia mientras conducen guerras alrededor del mundo e intentan ocupar y dominar toda expresión de vida y espíritu autónomas. Las falsas fronteras del mundo occidental continúan controlando el movimiento natural y progresista de personas además el de millones de refugiades, migrantes, solicitantes de asilo alrededor del mundo. Por generaciones, los EEUU y otros poderes imperialistas, han creado y agravado las condiciones que fuerzan globalmente a las personas negras a migrar.
Dado a los siglos de daño intencional que se ha cometido en contra de las comunidades negras a través del mundo, los EEUU tienen una responsabilidad fiscal, legal y ética de proveer refugio a migrantes, solicitantes de asilo, a víctimas de las eternas conquistas de nuestras culturas y tierras, particularmente para quienes son negres y matices, pobres y/o discapacitades, cuirs y/o trans.
BLMP imagina un mundo sin fronteras, donde la palabra “inmigrante” sea una obsoleta. Continuaremos cumpliendo nuestro mandato de edificar poder, comunidad y conocimientos en los EEUU mientras retamos el rol que los EEUU juega mundialmente en la creación de condiciones que nos fuerzan a abandonar nuestro hogares en primer lugar.
Continuamos soñando con un mundo donde las personas negras y sus seres querides tengan vivienda, autonomía de sus cuerpas, salud y la habilidad de viajar libremente, con dignidad libre de criminalización, racismo anti-negre, misoginia y toda forma de transfobia y homofobia.
Nuestra liberación está atada entre todes nosotres, levantémonos y resistamos por nuestra humanidad, nuestra dignidad y nuestra Tierra.

“No es nada nuevo por parte del gobierno de los EEUU el utilizar como armas el sistema de inmigración en contra de las personas negras. Lo que sí es nuevo en este momento es el renacimiento y despertar de las masas a las injusticias que las personas negras han sufrido siempre en tierras colonizadas, pero es más evidente ahora que antes. La administración del presidente Biden no puede ocultarse detrás de la ignorancia y tampoco lo pueden hacer las masas. El mundo se ha despertado y está al tanto de las atrocidades que amenazan la humanidad de personas negras a nivel mundial. La pregunta es, ¿cómo las masas puede decir presente en estos momentos, para proteger y defender a quienes estamos luchando por las protecciones humanitarias las cuales son nuestros derechos naturales? Podemos acusar y denunciar las injusticias pero no podemos quedarnos ahí. Debemos además desmantelar y destruir los sistemas e instituciones que se han creado en nuestra contra…y no detendremos nuestra lucha hasta que lo hagamos.”
