Henderson, Nevada

In February, the city council of Henderson accepted a six-month ban on issuing recreational marijuana licenses. The ban was extended by 30 days but is soon to expire on September 7th. With that being said, Henderson could expect to see recreational marijuana sales in early October. On Tuesday, September 5th, the Henderson City Council voted 3–2 to adopt an a decree to establish retail marijuana regulations and licenses.

Support For Recreational Marijuana Sales

Many residents feel as though the tax revenue from recreational sales could go toward the city’s school district. One of the reasons that prompted the support for recreational sales in Henderson is, the fact that the state of Colorado contributed their tax revenue from recreational sales to school districts. Another reason for support is the medical benefits of marijuana.

Opposition Facing Recreational Sales

Of course not everyone supports the retail selling of marijuana. According to the Las Vegas Review Journal, Councilman Dan Stewart thinks “there are too many unintended consequences that we just don’t know about.” Some would argue that councilman Stewart a conveys a very strong point since police chief Todd Peters stated “33 DUI arrests were recorded in July, with nine directly tied to marijuana. Also in August there were 54 DUI arrests with 10 related to marijuana”. However, it’s important know how the police are testing suspected drivers under the influence of marijuana. Anyone that is suspected of being under the influence of marijuana while driving is expected to submit a urine or blood sample for testing. This can be a conflict since marijuana stays present in the body for 30 days. Meaning if someone was pulled over under the suspicion of a DUI and that person is sober today but ingested marijuana a week ago, they can still face criminal charges.

Regulations

Zoning regulations require cultivation facilities, dispensaries, infusion manufacturing and independent testing labs to be at least 300 feet from community facilities and 1,000 feet from schools, public parks and playgrounds. Dispensaries must also be at least one-mile apart.

Most people who arrived on the strip of Las Vegas in the 1950’s now reside in Henderson today, which is why Henderson is coined as “Old Vegas”. Some people are not prepared for the changes that will inevitably occur. Others, view those changes as a new positive wave that may help the areas in need within the city.
