This decision comes after a federal judge declined to issue a summary judgment requested by both parties, leaving the question of whether XRP is an unregistered security unresolved.
The lawsuit, which has been a point of contention in the crypto community, was initiated by the SEC in 2020. The regulatory body accused Ripple of raising $1.3 billion through the sale of XRP, which it deemed an unregistered security. The SEC also sued Ripple’s CEO, Brad Garlinghouse, and co-founder, Christian Larsen.

Garlinghouse expressed his confidence following the judge’s decision, tweeting, “We said in Dec 2020 that we were on the right side of the law, and will be on the right side of history.
