In a significant development in the crypto legal landscape, the lawsuit between the U.S. Securities and Exchange Commission (SEC) and Ripple Labs, the company behind the cryptocurrency XRP, is set to go to trial. This decision comes after a federal judge declined to issue a summary judgment requested by both parties, leaving the question of whether XRP is an unregistered security unresolved.

The lawsuit, which has been a point of contention in the crypto community, was initiated by the SEC in 2020. The regulatory body accused Ripple of raising $1.3 billion through the sale of XRP, which it deemed an unregistered security. The SEC also sued Ripple’s CEO, Brad Garlinghouse, and co-founder, Christian Larsen.

The crux of the dispute lies in the classification of XRP. If deemed a security, the sale of XRP would be subject to stringent regulations, and Ripple could face penalties for its past sales. As of now, XRP is the sixth-largest cryptocurrency by market capitalization, boasting a total market value of over $27 billion.

Judge Analisa Torres of the Southern District Court of New York partially granted summary judgment motions from both sides. However, she left the case open until a jury can weigh in at trial or a settlement is reached. The judge’s decision marks a continuation of this years-long dispute and sets the stage for a potentially precedent-setting trial in the crypto space.

Garlinghouse expressed his confidence following the judge’s decision, tweeting, “We said in Dec 2020 that we were on the right side of the law, and will be on the right side of history. Thankful to everyone who helped us get to today’s decision — one that is for all crypto innovation in the US. More to come.”

As the crypto community awaits the trial date, this case serves as a stark reminder of the regulatory uncertainties surrounding cryptocurrencies. The outcome could have far-reaching implications for the classification and regulation of cryptocurrencies in the U.S.
