Ummmm … hate to break it to you, but CryptoLovers should not have used legacy legal concepts (and in rather undisciplined ways, mind you) if they wanted legacy processes to die their natural death.
On this point, the question for CryptoLovers is whether they want agencies like the U.S. Commodity Futures Trading Commission (CFTC) to learn about Ethereum from folks who know Ethereum, or folks who think they know Ethereum. One way or another, the CFTC is getting that info. It’s up to crypto to decide where they get that info from.
That’s the pragmatic point that’s motivating the suggestion to engage with regulators.
