Purpose of the CryptoPokers Art License

The CryptoPokers Management Team (the “Management Team”) hopes that a diverse group of stakeholders, including CryptoPokers NFT holders, creators, poker enthusiasts, and others, will participate in the community and creative activities of CryptoPokers to create a new poker brand originating from the web3 community. We hope that a new brand of poker will emerge from the web3 community. In order to ensure that the various stakeholders of CryptoPokers can engage in these activities with confidence, this CryptoPokers Art License (this “License”) is hereby established. We are committed to creating a new brand that will excite the CryptoPokers community and all poker enthusiasts, while appropriately protecting the rights of CryptoPokers NFT holders, creators, poker enthusiasts, and the management team.

Scope of this License

This license is intended for activities by unincorporated individuals or small groups of no more than five (5) people.

The following activities are not covered by this license. If you intend to conduct any of these activities, please contact the Management Team at the address above.

Commercial use for the purpose of generating revenue through the creation of goods or the development of applications
Use in the creation of generative NFT collections
Use for the purpose of offering in a form or for a purpose that could be considered securities.

Basic Policies of this License

This license will clarify the rights of CryptoPokers NFT holders, non-holders, etc., while adhering to the following basic policy.

<Basic Policy>
・When using content related to CryptoPokers, the creators of the CryptoPokers artwork must be respected, and appropriate credit must be given.
・Respect the feelings of the creators of CryptoPokers and the holders of NFTs about how they want their NFTs to be represented.
・Everyone is free to use the CryptoPokers name and logo in any activity, except for commercial use.
・Secondary creative activities and organizing poker tournaments related to CryptoPokers are basically welcome.

Rights of CryptoPokers NFT holders

CryptoPokers NFT holders may use their NFTs and their art to

-Creating illustrations, cartoons, videos, and other content using NFT art, and converting them to NFT.
(Excluding the sale of NFTs)
-Creation of goods such as T-shirts, mugs, playing cards, chips, etc.

CryptoPokers NFT holders are also entitled to the rights granted to CryptoPokers NFT non-holders.

Prohibited Conduct

・Making the CryptoPokers NFT art itself NFT
・Content that deviates from the image of CryptoPokers or damages the image of CryptoPokers
・Content that is offensive to public order and morals or discriminatory
・Directly copying, scanning, sampling, tracing, or otherwise using NFT art materials (illustrations, videos, audio, music, etc.) with no or little creativity (except in cases where the NFT owner uses his/her own NFT)
・Activities that misrepresent themselves as official CryptoPokers
・Content that violates the purposes and rules of this License
・Content that infringes or may infringe the rights of others
・Any activity that violates the law

CryptoPokers運営チーム（以下「運営チーム」）は、CryptoPokers NFT保有者やクリエイター、ポーカー好き等、多様なステークホルダーがCryptoPokersのコミュニティの盛り上げや創作活動に参加し、web3コミュニティ発の新たなポーカーブランドができることを願っています。多様なステークホルダーがCryptoPokersに関わる活動の一環として、収益を上げることも歓迎します。CryptoPokersに関わる多様なステークホルダーが安心して活動に取り組めるよう、このCryptoPokers Art License（以下「本ライセンス」）を定めます。

CryptoPokers NFT保有者やクリエイター、ポーカー好き、運営チーム等それぞれの権利を適切に保護しつつ、CryptoPokersコミュニティを盛り上げ、全てのポーカー好きが熱狂するような新しいブランド創出を目指していきます。

本ライセンスの対象

本ライセンスは、法人格を持たない個人または5人以下を目安とする少数の集団による活動を対象としています。

法人格を持つ者または5人より多い集団による活動においては、その是非について下記のアドレスより運営チームにお問い合わせください。

また、以下の活動については、本ライセンスの対象外となる活動となるため、実施意向のある場合は、上記アドレスより、運営チームにご連絡ください。

• グッズ制作やアプリケーション開発を通し、収益を上げることを目的とした商用利用
• ジェネレーティブNFTコレクションの作成での利用
• 証券とみなされうる形態・用途で提供することを目的とした利用

本ライセンスの基本方針

本ライセンスは、下記を基本方針としつつ、CryptoPokers NFT保有者、非保有者等の権利を明確化していきます。

<基本方針>

• CryptoPokersに関するコンテンツを利用する場合は、CryptoPokersのアート制作を行ったクリエイターを尊重し、適切なクレジット表記を入れること
• CryptoPokersに関わるクリエイターとNFTの保有者がいだく、自分のNFTがどのように表現されてほしいかという気持ちを尊重すること
• 商用利用を除く活動においては、CryptoPokersの名前やロゴを誰でも自由に使えることが可能です
• 二次創作活動や、CryptoPokersに関連するポーカートーナメントの主催などは基本的に歓迎します

CryptoPokers NFT保有者が有する権利

CryptoPokers NFT保有者は、保有するNFTやそのアートを利用して、以下のことを行うことができます。

ただし、利用の際はCryptoPokersへの適切なクレジット表記をお願いいたします。

• アートをあらゆる媒体でコピーまたは共有する
• 商用利用目的ではない範囲での下記の二次利用行為

-保有するNFTのアートを利用し、SNS等で利用するアイコンやバナー等の制作

-保有するNFTのアートを利用した、イラストや漫画、動画等のコンテンツの作成とその無料配信

-保有するNFTのアートを利用した、イラストや漫画、動画等のコンテンツの作成とそのNFT化（※NFTを販売することは除く）

-Tシャツやマグカップ、トランプやチップ等のグッズ制作

• 保有するNFTを賞品とした、参加費無償のポーカートーナメント等の開催

なお、CryptoPokers NFT保有者は「CryptoPokers NFT非保有者に許諾される権利」についても認められます。

CryptoPokers NFT非保有者に許諾される権利

CryptoPokers NFT非保有者は、CryptoPokersのアートを利用して、以下のことを行うことができます。

ただし、利用の際はCryptoPokersへの適切なクレジット表記をお願いいたします。

• アートをあらゆる媒体でコピーまたは共有する
• 商用利用目的ではない範囲でのCryptoPokersのロゴの利用

運営チームに留保される権利

運営チームは、すべてのCryptoPokers NFTのアートとその派生物（運営チームではない者が制作した物を含む）をプロモーション等のために自由に使用する権利を有します。

禁止行為

• CryptoPokers NFTのアート自体をNFT化すること
• CryptoPokersのイメージを逸脱する、イメージを損なう内容
• 公序良俗に反する内容、差別的な内容
• 直接的にNFTのアートの素材（イラスト、動画、音声、楽曲等）をコピー、スキャン、サンプリング、トレース等で使用するなど、創作性が無いまたは低いもの (NFT保有者が自身が保有するNFTを用いて行う場合を除く)
• CryptoPokers公式と詐称しての活動
• 本ライセンスの目的とルールに反する内容
• 他者の権利を侵害する、または侵害するおそれがある内容
• 法律に抵触する行為

閲覧者、受取者にとってわかりやすい場所、容易にアクセスできる場所にCryptoPokersへのクレジットを記載する様にしてください

NFTのメタデータのdescription内に、CryptoPokersへのクレジットを記載する様にしてください
