California’s Attorney General won’t extend the CCPA’s January 1st, 2020 deadline

Update from California’s AG

Only one week after the end of the public comment period for the California Consumer Privacy Act’s (CCPA), where consumers and businesses were given the opportunity to provide perspective on the CCPA’s draft regulations, Attorney General (AG) Xavier Becerra has come forward with several key statements.

First and foremost, AG Becerra stated that there will be no extension to the January 1st, 2020 deadline to comply with the CCPA.

This clarifies an important question. SB-1121 introduced an enforcement delay, stating that the AG can only proceed to bring an action after July 1st, 2020. Some businesses believed that this meant that the compliance deadline had also been shifted from January 1st to July 1st, 2020. In the light of looming uncertainty, several businesses had requested such a delay, pointing to the fact that the CCPA and its regulations are still a moving target. Attorney General Becerra has now clearly stated that no extension of the January 1st, 2020 deadline is planned.

Another key point made by AG Becerra is a clarification related to how he will enforce the CCPA. The Attorney General stated that he plans to show leniency towards organizations making a genuine effort to comply, highlighting that even if they struggle to meet the compliance requirements, they would be “looked upon kindly.”

Organizations failing to make the required efforts, however, will be treated with no leniency whatsoever. As stated by AG Becerra:

If they are not (operating properly) … I will descend on them and make an example of them, to show that if you don’t do it the right way, this is what is going to happen to you.”
