Anna Babych deprived of a driving license
Two attentive readers have already sent us the number of the administrative case, from which we learned that —
In March, a driver named Babich Anna Valeriivna was deprived of her driving license for 1 year for driving while intoxicated.
The incident itself, as stated in the resolution of the Obolon District Court, took place on October 30, 2021. The police found that PERSON_1 was driving a Porsche car with signs of alcohol intoxication: the smell of alcohol from the mouth, reddening of the face.” PERSON_1 refused to undergo an examination for intoxication, again, if the decree is correct.
The defender — Mr. Kolomiychuk — appealed the decision, but in mid-August, the Kyiv Court of Appeal returned the appeal to the applicant due to the fact that the applicant provided only a warrant and a certificate to confirm the authority but did not provide an extract from the contract (as still required by the Code of Ukraine on Administrative Offenses).
Last week, we sent AEQUO partner Ms. Anna Babich requests for a comment on the event itself because the name PERSON_1 is confusingly similar to Anna. We also reached out to her defense attorney for comment on the defense’s future strategy. They have read the message but have not commented yet.
The story would be incomplete without three important clarifications:
- About 13 years ago, I also got into drunken driving. I honestly drove with the policemen to another part of Kyiv for inspection and then pleaded guilty in court. For some reason, this decision is not in the registry. But you have no idea how ashamed I am to this day for what I did. But there is also an educational function in that event: since then, he has not even thought of repeating the feat.
- The second clarification is that the legal market has never publicly discussed what I wrote about. After readers wrote to us about these cases, we consulted with the board for two days about whether it was worth writing about it. Because on the one hand, this story does not relate directly to the legal market; after all, everything happens in life. On the other hand, we position the Dead Lawyers Society as a media that writes about and for Ukrainian lawyers. In other words, we must write about any information that is important to the community.
- Well, the third thesis is as follows: we do not have an adequate opportunity to check all partners of law firms in the court register. Therefore, if you are familiar with stories when a partner behaved inconsistently with his high moral and ethical social status, then write to us about it.
