What is eDiscovery?

Anyone involved in a lawsuit or a government investigation has or will encounter eDiscovery. So to begin, let’s start with what “discovery” is.

Discovery is the pre-trial procedure in a legal case where parties exchange evidence with the other side. Evidence used to mean boxes and boxes of paper, as well as physical evidence — meaning something that’s tangible.

Now, discovery has expanded to Electronically Stored Information, or ESI. All of your emails, word processing documents, spreadsheets, text messages, and social media posts are ESI. And in a lawsuit or investigation, all of those data sources contain potential evidence — meaning they could be subject to discovery.

And that is where eDiscovery comes in. Ediscovery takes data from its original source and boils it down to the evidence that will prove or disprove the claims in a case. In this process, data is identified, collected, processed, reviewed by attorneys, and then produced to the other side as part of the evidence exchange.
