Based of what happened in chat, Ben based as he should of done and in these circumstances could not provide evidence because it is voice chat.

He had no clue that it would happen and so did as he could in that moment, As there was no witnesses either cheese or ben could backup their points, and because ben is in a position of authority, The overall judgement goes to ben

Verdict: Unsucessfull, No reason to remove a justified warning.
