Your privacy is important to us at Everybody Helping. We want to be clear how we use your information, and the ways in which you can protect your privacy.

Our Privacy Policy explains:

  • What information we collect and why we collect it.
  • How we use that information and when we disclose it.
  • How to access and update your information.
  • The steps we take to protect your information.

This Privacy Policy applies to the information that we obtain through your use of Everybody Helping services, including our website (https://www.everybodyhelping.com), platforms, and web-based tools (collectively the “Services”). Please familiarize yourself with our policies, and if you have any questions contact us at legal@everybodyhelping.com. This policy is incorporated into and is subject to the Terms of Service Agreement (the “Terms”).

I. INFORMATION WE COLLECT

1. Information you provide to us

We collect the following information:

a. Account and Profile Information

We collect information about you, as an individual, and your organization, as a 501(c)(3) public nonprofit organization, company when you create an account, create or modify your profile, and make and receive donations through our Services. Information we collect, as an individual, can include your name, username, address, email address, phone number, and payment card details. Information we collect, as an organization, can include your organization name, username, address, email address, phone number, Federal EIN number, and bank account details. You provide this information directly through our Services.

b. Content

We collect and store content that you create, input, submit, post, upload, transmit, or store in the process of using our Services. Such content may include any personal or other sensitive information submitted using our Services, such as personal information, payment information, and other information such as regulatory compliance materials.

c. Other submissions

We collect other data that you may submit to our Services or us directly, such as when you request customer support or communicate with us via email or social media sites.

2. Information we collect from your use of our Services

a. Web Logs and Analytics Information

We record certain information and store it in log files when you interact with our Services. This information may include Internet protocol (IP) or other device addresses or ID numbers as well as browser type, Internet service provider, URLs of referring/exit pages, operating system, date/time stamp, information you search for, locale and language preferences, your mobile carrier, and system configuration information. We and our analytics providers also collect and store analytics information when you use our Services to help us improve our Services.

b. Cookies and Other Tracking Technologies

We use various technologies to collect information, including cookies that we save to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory. We use cookies to improve and customize our Services and your experience; to allow you to access and use the Services without re-entering your username or password; and to count visits and understand which areas and features of the Services are most popular. We may also associate the information we store in cookies with personal information you submit while on our Services. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of our Services.

c. Special Privacy & Security Provisions for Donors

Everybody Helping respects and protects your privacy and will never sell or rent your personal information to other individuals or companies. The information that you provide is used only to complete your donation. With your permission, your name and account information will be provided to the nonprofit organization(s) you support through Everybody Helping.

When you create an account with Everybody Helping you may choose to receive your donation records at tax time and occasional email updates on your favorite nonprofit organizations. If you do not wish to hear from us, simply update your contact settings, unsubscribe from any mailing, or contact us directly.

d. Special Note on Nonprofit Organizations

Each nonprofit organization has its own policies regarding privacy of donor information. Please contact the nonprofit organization(s) you support to directly to learn about their privacy policies. We will only pass on the information you provide us if you authorize us to do so.

e. Information Shared with Nonprofits You Support

When you make one-time or monthly donations via Everybody Helping products, we only share the information associated with your Everybody Helping account with the recipient nonprofit organization. Everybody Helping respects donor privacy and only shares information with donor consent.

f. Complying with Donor Advised Fund Regulations

Some donations through the Everybody Helping services are processed by The Everybody Helping Foundation (“EHF” or the “Foundation”), a Texas nonprofit corporation and donor advised fund, known as The Everybody Helping Fund (tax ID 81–4858492) (the “Fund”). The Everybody Helping Fund distributes these donations to the nonprofit organization that you, as an individual contributor to the Fund recommended. However, some donations made through the Everybody Helping Services are processed directly by the nonprofit of your choice and not by the Fund. When your donation is processed by the Fund, as required by the Internal Revenue Service (“IRS”), the Fund has exclusive legal control over the donations to our donor-advised fund. All donations are final and may not be refunded. In the rare event that a nonprofit organization you have recommended does not satisfy the Fund’s criteria for receiving donations (e.g., it has been classified by the IRS as a disqualified supporting organization, it cannot or does not accept donations, is not recognized by the IRS as a section 501(c)(3) public nonprofit organization, or is not in good standing with federal and state regulators), the Fund will select an alternate, similar nonprofit organization to receive your donations.

g. Sharing of Information to the Everybody Helping Fund

The Everybody Helping Foundation, and its donor advised fund, The Everybody Helping Fund, provides specific donation collection and distribution services to Everybody Helping in order to help you support the causes you love. From time to time, Everybody Helping may share your information with the Fund for the purpose of operating the donor advised fund into which your donations are deposited. The Fund has certain legal obligations that it is required to comply with and reserves the right to use and disclose certain donation data (such as the nonprofit’s name, address, and donation amount) for legal and regulatory purposes including reporting information to the IRS on its Form 990 relating to grants made from its Donor Advised Fund.

3. Information we collect from other sources

a. Information from third party services

We may obtain information, including personal information, from third parties such as our partners and service providers, and combine it with other information we collect from you.

II. HOW WE USE INFORMATION WE COLLECT

We may use the information we collect for a variety of purposes, including but not limited to:

  • Provide, operate, maintain, improve, personalize, and promote our Services;
  • Develop new products, services, features, and functionality;
  • Enable you to access and use our Services;
  • Process and complete transactions, and send you related information, including purchase confirmations and invoices;
  • Communicate with you, including responding to your comments, questions, and requests; providing customer service and support; providing you with information about services, including technical notices, updates, security alerts, administrative messages, or advertising or marketing messages; and providing other news or information about us and our select partners;
  • Monitor and analyze trends, usage, and activities in connection with our Services; and
  • Investigate and prevent fraudulent transactions, unauthorized access to our Services, and other illegal activities.

We may also use the information we collect for other purposes about which we notify you.

III. INFORMATION SHARING AND DISCLOSURES

We may share your information in the following ways:

With your express consent

We will share your personal information with companies, organizations, or individuals outside of Everybody Helping when we have your consent to do so.

Your use

When you use our Services, certain features allow you to make some of your content accessible to the public or other users of the Services. We urge you to consider the sensitivity of any information prior to sharing it publicly or with other users.

Access by Everybody Helping

Everybody Helping may be able to:

  • Access information in and about your Everybody Helping account;
  • Disclose, restrict, or access information that you have provided or that is made available to you when using your Everybody Helping account, including your content; and
  • Control how your Everybody Helping account may be accessed or deleted.

Service Providers, Business Partners and Others

We may share your information with service providers and other third parties who perform services on our behalf, such as infrastructure, analytics, marketing, and advertising services. We provide your payment information to our service providers for payment processing and verification. Service providers such as analytics providers may collect information about your online activities over time and across different online services when you use our Services.

Compliance with Laws and Law Enforcement Requests; Protection of Our Rights

We may disclose your information (including your personal information) to a third party if:

  • We believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process or governmental request;
  • To enforce our agreements, policies and terms of service;
  • To protect the security or integrity of Everybody Helping’s products and services;
  • To protect the property, rights, and safety of Everybody Helping, our customers or the public from harm or illegal activities;
  • To respond to an emergency which we believe in the good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person; or
  • To investigate and defend ourselves against any third-party claims or allegations.

Business Transfers

We may share or transfer your information (including your personal information) in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. We will notify you of such a change in ownership or transfer of assets by posting a notice on our website.

Aggregate or Non-identifying Data

We may share aggregate or other non-personal information that does not directly identify you with third parties in order to improve the overall experience of our Services.

IV. THE CHOICES YOU HAVE WITH YOUR INFORMATION

You may decline to share certain personal information with us, in which case we may not be able to provide to you some of the features and functionality of our Services. You may update or correct your personal information at any time by accessing the account settings page on the website or within our platform. You may opt out of receiving promotional communications from Everybody Helping by using the unsubscribe link within each email. Even after you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us regarding the Services.

V. CHILDREN’S PRIVACY

Our Services are not directed to individuals under 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us at legal@everybodyhelping.com.

VI. COMPLAINTS, QUESTIONS, AND ARBITRATION

In compliance with the EU-U.S. Privacy Shield and U.S.-Swiss Safe Harbor Principles, we strive to resolve all complaints about privacy and the collection or use of customer information. If you have questions about our participation in the Privacy Shield or Safe Harbor programs or have a complaint, please send an e-mail to legal@everybodyhelping.com.

Under the Privacy Shield and Safe Harbor programs, any unresolved privacy complaints can be referred to an independent dispute resolution mechanism. We use the International Centre for Dispute Resolution®/American Arbitration Association®. If you feel that we have not satisfactorily addressed your complaint, you can visit the ICRD/AAA website at https://apps.adr.org/webfile/ for more information on how to file a complaint. In some cases, you may be able to invoke binding arbitration.

VI. CHANGES TO THIS PRIVACY POLICY

We may change this Privacy Policy from time to time. If we make any changes, we will notify you by revising the version and date at the top of this Privacy Policy and, in some cases, where appropriate we may provide you with additional notice (such as adding a statement to the log-in screen or sending you an email notification). Your continued use of our Services after the revised Policy has become effective indicates that you have read, understood, and agreed to the current version of this Policy.
