Chhattisgarh CJ AK Tripathi resigns after appointment as Member (Judicial) Lokpal, Justice PK Mishra appointed acting Chief Justice As Justice Ak Tripathi tendered his resignation from the office of Chief Justice of Chhattisgarh High Court after his appointment as Member (Judicial), Lokpal, Justice PK Mishra has been appointed the Acting Chief Justice of the Chhattisgarh High Court.

SC Collegium recommends elevation of 5 advocates to Bombay HC, sends back 4 names.

The Supreme Court collegium has recommended the elevation of five lawyers as judges of the Bombay High Court. The collegium comprising Chief Justice of India Ranjan Gogoi, Justice SA Bobde and Justice NV Ramana approved the following names: Avinash G. Gharote N.B. Suryawanshi Madhav Jamdar Anil Kilor Milind Narendra Jadhav The court had ten names before it. In addition to the five names listed above, it was also considering the candidature of Advocates Avinash S. Deshmukh, Manjari Dhanesh Shah, J.R. Shah, Abhay Kumar Ahuja and Devidas Pangam. The ten recommendations had been forwarded by the Bombay High Court collegium in May last year.

Averment of political rivalry by itself does not constitute a ‘Plea Of Mala Fides’: SC

The Supreme Court has observed that mere averment of political rivalry by itself would not constitute a plea of malafides to interfere with an administrative decision taken by the state. The State of Tamil Nadu, in 1980 had allotted some land to an Agricultural Horticultural Society. In 1989, the state resumed the land for public purpose, namely, development of sports facilities without affecting the environment and development of horticulture and horticulture research.

Companies act does not stipulate any period for completion of serious fraud investigation: SC

Holding that there is no stipulation of any fixed period for completion of a Serious Fraud investigation, the Supreme Court has observed that the stipulation in sub-section (3) of Section 212 of the Companies Act, 2013, in relation to the submission of the report, is not mandatory, but directory. The bench comprising Justice AM Sapre and Justice UU Lalit were dealing with an appeal filed by the Serious Fraud Investigation Office against Delhi High Court order that termed arrests illegal because the period of investigation was ‘over’.

Drunkenness while on duty a serious misconduct: SC upholds dismissal of a police constable.

The Supreme Court upheld dismissal of a police constable for drunkenness and misbehavior with the public. Constable Prem was found in an inebriated state on 1 November 2006 and was misbehaving with the public. After conducting the enquiry, the Superintendent of Police, Pithoragarh passed an order of dismissal, holding that the charge of drunkenness and misbehavior was proved.

Bombay HC issues notice to ECI in PIL seeking stay on release of biopic on Narendra Modi

In reply to a PIL filed by Satish Sugriv Gaikwad, national president of the Republican Party of India (I) the Bombay High Court on Friday issued a notice to the Election Commission of India (ECI). Satish Sugriv Gaikwad alleged, “In the guise of the movie surrogate advertising of sitting Prime Minister is sought and with motive to circumvent the Model Code of Conduct.”
