BLOG: AI IN CREATIVE WRITING
S2: Copyright at Stake: Can AI Be a Coauthor?
EXPLORING THE IMPACT OF ARTIFICIAL INTELLIGENCE ON CREATIVE WRITING
A co-author is a person or entity that holds equal rights to a work. Currently, on a global scale, copyrights are granted exclusively to natural persons.
However, the growing use of generative AI chatbots as content creation assistants raises new questions about the applicability of this rule.
There is still no specific legislation that regulates the authorship of content produced by computers, creation software, or AI. Although a chatbot can contribute significantly to a literary work, it does not currently have any legal rights over that creation.
Some key arguments have been discussed to determine if a chatbot could eventually be recognized as a co-author.
Among them, the following stand out:
- Degree of contribution: How important was the chatbot to the work?
- Originality and creativity: Was the AI’s contribution innovative or did it merely replicate existing patterns?
- Intent of the human author: Does the author formally recognize the AI as a co-author?
