Elimination of the One Time Parental Medicaid Consent Could Ease Billing for Special Education Services

School districts would not be required to obtain consent from parents before billing Medicaid for reimbursement of school-based services under the proposed rule change and guidance update by the U.S. Department of Education and U.S. Department of Health and Human Services. The proposed rule change would simplify the billing process, making it easier for school districts to access funds to help reimburse Medicaid eligible services provided to students with disabilities.

Section 504 Regulation Changes Expected in August

For the first time since 1977, the U.S. Department of Education (USDOE) announced it intends to amend Section 504 regulations. School administrators hope the changes will provide more clarity on how Section 504 requirements align to and are distinct from IDEA. Greater clarity in the Section 504 regulations will help educators and families improve the implementation of both. Based on the text of the USDOE announcement, some hypothesize that mental health and school discipline will be among the areas addressed in the proposed amendment to Section 504. The proposal is expected to be issued in August 2023.
