OPEN LETTER | Withdrawing refugee status because of political affiliation jeopardizes our civil liberties
In an open letter, more than 250 Belgian and international academics condemn the demand by Secretary of State Nicole De Moor (CD&V) to revoke the refugee status of pro-Palestinian activist Mohammed Khatib: “As academics committed to justice and respect for human rights, we strongly denounce the possibility of refugee status being revoked on political grounds.”

On Monday April 15th, the Secretary of State for Asylum and Migration, Nicole De Moor, announced in a press release that she had requested the Commissioner General for Refugees and Stateless Persons (CRRA/CGVS) to revoke the refugee status of Mohammed Khatib, coordinator of Samidoun, an organization supporting Palestinian political prisoners. De Moor added that this decision is based on a report by the Coordination Unit for Threat Analysis, which describes Mohammed Khatib as a ‘hate preacher’.
As academics committed to justice and respect for human rights, we strongly denounce the possibility of refugee status being revoked on political grounds.
As a reminder, refugee status is defined by the 1951 Convention relating to the Status of Refugees, which Belgium ratified. Therefore, Belgium is obliged to protect those who benefit from this status. Mohammed Khatib obtained this status in accordance with what is stipulated in the convention and as a result of Belgian law. The purpose of refugee status is to protect people’s lives and their right to dignity. It cannot be granted or withdrawn on political grounds. Conditioning of refugee status, residential status or citizenship on the basis of the political activity or affiliation of the person in question is a dangerous precedent that creates a hierarchy between different citizens and different types of citizenships. The right to freedom of expression and the right to take part in a social movement cannot be subjected to political arbitrariness. Today, it is about support for the Palestine cause, and tomorrow…?

In this case, Nicole de Moor’s announcement is targeted at delegitimizing the Palestinian struggle and support for Palestine in Belgium. In Belgium, everyone, refugee or not, Palestinian or not, must be free to express themselves and to organize, must be free to defend the Palestine cause, the right of return of the Palestinian refugees to their land, or to denounce the genocide in Gaza.
Moreover, Mohammed Khatib has not been found guilty of any crime or offence: the accusations of being a threat or preaching hatred draw on a risk assessment made by the Coordination Unit for Threats Analysis, and are not the result of a transparent judiciary procedure. The possible revocation of the refugee status of Mohammed Khatib fits in a dangerous and ever expanding trend to preventively suspend the administrative status of people on the ground of the potential risk they could represent. These risk-assessments are rarely made on the basis of objective grounds, but on the basis of politically-situated sentiments, which are highly contingent and change with time. These preventive measures have dangerous and far-reaching consequences and create a gap within the law whereby administrative sanctions can be imposed on arbitrary grounds. Muslims and migrants are particularly vulnerable for these kinds of risk assessments, which are too often infused by racial and political prejudice and bias.

De Moor’s announcement is part of a wider context of repression and defamation targeting the Palestinian movement and its supporters in Belgium. For example, ZinTV, a Brussels-based media outlet that documents social struggles, has been under various pressures since October 2023, for hosting an event by Samidoun: pressures and defamation from the local council and on social networks, attempts at intimidation, which culminated in a raid by an anti-terrorist brigade on their premises in March 2024. In Flanders, the independent news website De Wereld Morgen and the peace organization Vrede have been the target of attempts of political censorship, including explicit political intimidation and the utilization of administrative means to serve it. These political attempts of censoring independent media that are now joined with attempts to silence voices that challenge mainstream politics create a significant threat to the public debate and civil liberties in Belgium.
The right to freedom of expression, the right to organize, the right to engage in political activity: these fundamental rights must be protected.

Lundi 15 avril, la Secrétaire d’Etat à l’Asile et à la Migration, Nicole De Moor, a annoncé dans un communiqué de presse qu’elle avait demandé au Commissariat Général aux Réfugiés et Apatrides (CRRA/CGVS) de révoquer le statut de réfugié de Mohammed Khatib, coordinateur de Samidoun, une organisation soutenant les prisonnier·es politiques palestinien·nes. N. De Moor ajoute que cette décision est basée sur un rapport de l’Organe de Coordination pour l’Analyse de la Menace (OCAM), qui décrit Mohammed Khatib comme un “prêcheur de haine”.

Pour rappel, le statut de réfugié·e est défini par la Convention de 1951 relative au statut des réfugiés, que la Belgique a ratifiée. La Belgique est donc tenue de protéger les personnes qui en bénéficient. Mohammed Khatib a obtenu ce statut conformément à ce qui est stipulé dans la convention et du fait de la loi belge. Le statut de réfugié·e a pour but de protéger la vie des personnes et leur droit à la dignité. Il ne peut être accordé ou retiré pour des raisons politiques. Conditionner le statut de réfugié, le statut de résident·e ou la citoyenneté en fonction de l’activité ou de l’affiliation politique de la personne concernée est un précédent dangereux qui crée une hiérarchie entre les différent·es citoyen·nes et les différents types de citoyenneté. Le droit à la liberté d’expression et le droit de participer à un mouvement social ne peuvent être soumis à l’arbitraire politique. Aujourd’hui, il s’agit de soutenir la cause palestinienne, et demain?

Dans ce cas, l’annonce de N. de Moor contribue à délégitimer et réprimer la lutte palestinienne et le soutien à la Palestine. En Belgique, chacun, réfugié·e ou non, Palestinien·ne ou non, doit être libre de s’exprimer et de s’organiser, doit être libre de défendre la cause palestinienne, le droit au retour des réfugié·es palestinien·nes sur leur terre, ou de dénoncer le génocide à Gaza.
De plus, Mohammed Khatib n’a été reconnu coupable d’aucun crime ou délit : les accusations d’être une menace ou de prêcher la haine sont basées sur l’analyse faite par l’OCAM, et ne sont pas le résultat d’une procédure judiciaire transparente. L’éventuelle révocation du statut de réfugié de Mohammed Khatib s’inscrit dans une tendance dangereuse et de plus en plus répandue qui consiste à suspendre préventivement le statut administratif de personnes en raison du risque potentiel qu’elles pourraient représenter. Ces évaluations de risque sont rarement effectuées sur la base de critères objectifs, mais plutôt sur la base de sentiments politiques, qui sont hautement contingents et évoluent avec le temps. Ces mesures préventives ont des conséquences dangereuses et profondes et créent un vide juridique qui permet d’imposer des sanctions administratives pour des motifs arbitraires. Les populations musulmanes et migrantes sont particulièrement vulnérables à ces types d’évaluation des risques, qui sont trop souvent imprégnés de préjugés et de partis pris raciaux et politiques.

L’annonce de N. De Moor s’inscrit dans un contexte plus large de répression et de diffamation visant le mouvement palestinien et ses partisans en Belgique. Par exemple, ZinTV, un média bruxellois qui documente les luttes sociales, subit diverses pressions depuis octobre 2023, pour avoir accueilli un événement de Samidoun : pressions et diffamations de la part du conseil communal et sur les réseaux sociaux, tentatives d’intimidation, qui ont culminé avec la descente d’une brigade anti-terroriste dans leurs locaux en mars 2024. En Flandre, le site d’information indépendant De Wereld Morgen et l’organisation pacifiste Vrede ont été les cibles de tentatives de censure politique, y compris d’intimidation politique explicite et d’utilisation de moyens administratifs à cette fin. Ces tentatives de censure de médias indépendants, qui s’ajoutent maintenant aux tentatives de faire taire les voix dissonantes, constituent une menace importante pour le débat public et les libertés civiles en Belgique.
Le droit à la liberté d’expression, le droit de s’organiser, le droit d’exercer une activité politique : ces droits fondamentaux doivent être protégés.
