Kajiado High Court Awards Bishop Ksh787 Million in Landmark Ruling

Bishop Joel Chola, who is the executive director of Clarence Matheny Leadership Training Institute was, on Monday, awarded Ksh787 Million in a landmark ruling by a Kajiado High Court.

Justice Reuben Nyakundi ordered that the money is paid to the organization in three days as compensation for the Ngong’ land used to construct phase 2A part of the Standard Gauge Railway (SGR).

“I order that the NLC pays a sum of Ksh 787, 987,569 to Clarence Matheny Leadership Training Institute not later than this week on Thursday,” Justice Nyakundi stated.

According to Nyakundi, the money accrued after NLC bosses, led by Chairman Muhammad Swazuri, allegedly delayed the process of their compensation.

The Institute was formally requested, on January 3, 2018, to allow the Chinese construction company to begin building pillars on their property.

After the ruling, which was also attended by Swazuri in person and commission lawyers, Bishop Chola stated that justice had been served.

“This is landmark ruling in a landmark case that has dragged on for a long time. At least justice has been served to us,” he declared.

According to Bishop Chola’s arguments in court, the organization obliged to the compulsory acquisition of its land by the Kenya Railways and later by NLC, and promised to support the national project.

Bishop Chola also noted that his institution filed the formal application for compensation in February 2018 in the presence of several NLC officials including its lawyer and a surveyor from KR.

The land in Ngong lies squarely on phase 2A of the SGR and houses a super bridge that contains 17 major pillars.
