Updates to Proposed Cannabis Social Equity Rules: Supplemental CR 102

The LCB has heard your feedback on the proposed rules for the CR 102 filed in June 2024 for the next round of Cannabis Social Equity license applications under SB 5080. The CR 102 is the second stage of the rulemaking process. The updated draft rules (also known as a “Supplemental CR 102”) were presented at the LCB Board meeting on Oct. 23, 2024 following the stakeholder engagement period, to include feedback received.
Proposed Draft Rules
Here is an overview of some of the proposed changes for the Social Equity Scoring Rubric:
- The maximum number of points for living in a Disproportionately Impacted Area (DIA) increased from 40 points to 60 points.
- The maximum number of points for an applicant convicted of a cannabis-related drug offense increased from 40 points to 60 points.
- The maximum number of points for an applicant’s family member convicted of a cannabis-related drug offense increased from 5 points to 30 points.
- The maximum number of points for time served in jail or prison decreased from 80 points to 60 points.
- The maximum number of points for household income below the median in the State of Washington increased from 30 points to 45 points.

The formal public comment period is open now until Dec. 4, 2024. Written comments on the draft rules can be sent to rules@lcb.wa.gov.
The public hearing is scheduled for the Dec. 4, 2024 Board Meeting.
