What should a person do when a woman doesn’t want a divorce and a man wants one?

There can be several things a man should do when he wants a divorce and his wife does not. The very first thing is to discuss the problem with his wife calmly and try to solve it by NEGOTIATION. He may be able to come to an agreement with her, or at least take time off from their argument. Otherwise, he can -

  1. CONSULT a lawyer who can help him understand the process so he can make informed decisions about how he should proceed. A lawyer can also handle court proceedings and help him get a fair settlement that recognizes his contributions to the family.
  2. Notify his wife that he wants a divorce. He can write her a letter or send her an email or a well-written professional LEGAL NOTICE. The notice shall contain all the basic reasons why he wants a divorce.
  3. Get all his financial DOCUMENTS in order. He should have a record of all income and expenses, as well as any debts that he may incur during the course of his marriage. This will make it easier to understand his financial situation, and he can prepare for what may be a very difficult time ahead.
  4. Save his emails and text messages in case there are any disputes about what was said or who did what to cause the problems. He should also save any letters he sent her and received from her. This will help him remember what happened and provide EVIDENCE about what did or did not happen if there is a dispute about the events in their relationship.
  5. WAIT for a period of time (a few months is reasonable) and start living separately from his wife before he applies for a divorce. This will allow him to think about what happened and to be sure that he takes the right decision. It will also give his wife a chance to understand the gravity of what she has done or realise her mistakes.
  6. Make arrangements with his partner for the care of their CHILDREN in case his wife refuses to let him see the children. This will ensure that he is not distracted by family issues when he goes to court.

One must not rush into a divorce without having thought about the consequences BUT it is also important to remember that it is possible to get over a divorce and put the past behind, to build a better future.
