Case № 18–06, 101 M.S.Ct. 105

Per Curiam.
Justice Elevic took no part in the consideration or decision of this case.

In a copyright case brought by Petitioner under the federal Copyright Act, the Sacagawea Supreme Court held that an online link to Petitioner’s publically available work did not constitute copyright infringment, and awarded ten million dollars to Respondent (the defendant in the case below) for damages caused to Respondent’s news brand.

Federal law clearly states that “[n]o State court shall have jurisdiction over any claim for relief arising under any Act of Congress relating to patents, plant variety protection, or copyrights.” 28 U.S.C. § 1338. Accordingly, the Sacagawea Supreme Court lacked subject matter jurisdiction over the case, and we must reverse.

The petition for certiorari is granted. The judgment of the Sacagawea Supreme Court is reversed.

It is so ordered.
