The US Justice Department Says The Arizona Audit Violates Federal Election Laws
The Justice department is accusing Cyber Ninjas of voter intimidation and illegal seizure of ballots
Remember when I said that the crazy in Trump World got turned a up a few notches? I didn’t think it was possible, but it has been turned up a few more notches.
The US Justice Department’s Civil Rights Division has sent a letter to Karen Fann, the president of the GOP Senate in Arizona, alleging that the audit of the 2020 votes in Maricopa County violates several Federal election laws.
“We have a concern that Maricopa County election records, which are required by federal law to be retained and preserved, are no longer under the ultimate control of elections officials, are not being adequately safeguarded by contractors, and are at risk of damage or loss.”
The letter goes on to cite problems such as the lack of security at the Coliseum where the recount is being held, the lack of impartial observers, and the lack of security of the ballots themselves.
Both the press and independent observers are barred from the Coliseum while supporters of the Big Lie that Trump won the election are allowed in. One of the people hired to count ballots, Anthony Kern, was photographed at the Capitol during the insurrection.
The Justice Department is also concerned with Cyber Ninjas’ intention to call voters.
Think about that for a moment. Say you were a Trump voter in 2016 who voted for Biden in 2020. And let’s say that you received a call from a representative of the firm doing the recount. That representative tells you that there is a problem with your ballot and they need to verify it.
Knowing that when the state’s election commissioners at first refused to allow the recount, they and their families received death threats from Republicans around the country and had to go into hiding, would you admit that you didn’t vote for Trump in 2020?
This is what is known as voter intimidation.
Here’s how the Justice Department phrased it:
“Past experience with similar investigative efforts around the country has raised concerns that they can be directed at minority voters, which potentially can implicate the anti-intimidation prohibitions of the Voting Rights Act. Such investigative efforts can have a significant intimidating effect on qualified voters that can deter them from seeking to vote in the future.”
And that crazy that I mentioned? How about after each ballot is counted, it is moved to a station where it is photographed and then fed through a device that resembles a scanner. The purpose of this device is to check for traces of bamboo in the paper on which the ballot was printed.
Bamboo you ask? The head of Cyber Ninjas, the firm doing the recount, believes that Trump won the election and subscribes to a conspiracy theory that says that fake ballots manufactured in Asia (hence the bamboo) were smuggled in by Biden’s campaign to ensure his victory.
Yeah, it doesn’t make any sense to me either but not much in Trump World makes sense.
Here’s another good one. Ballots are being examined under UV lights to look for watermarks. That’s another conspiracy theory. That fake ballots have watermarks that can only be seen under UV light.
How much is all this crazy costing? $150,000 which turned out to not be enough so outside groups including One American News Network are holding fundraisers to make up the difference.
In it she notes that ballots are left unattended on tables, there is no procedure to keep tallied and untallied ballots separate and ballots are tallied using scrap paper instead of official tally sheets.
She also points out that the equipment and software being used has not been tested by a federal laboratory or certified by the federal Election Assistance Commission, as state law requires to prevent fraud.
There is the possibility that the software being used could change ballots. Another possibility is that the images of fake ballots could be pre-loaded into the systems being used.
Believers in the Big Lie claim the election was stolen using these very same types of fraud.
The results of the tallies should be entered into an electronic spreadsheet by a team of people with representatives from both parties. Instead, the results are being entered by a single person with no supervision from either party or independent observers.
Basically, what this is is a three ring circus with a very short run. The Coliseum is only available until May 14. Starting May 15, it is booked for high school graduations. The recount started on April 23 and so far only 10% of the ballots have been counted. There is no way that the recount will be finished by May 14.
Initially, the Arizona GOP who started this fiasco wanted to stop the count on May 14, moved the ballots and equipment to a secure area of the Coliseum until the graduations were over and then move it all back and resume the count.
The state fair board who oversees the rentals of the Coliseum has said no. I can’t wait to see what happens after May 14, can you?
What’s really scary about all of this is that it is very possible that this “audit” will “find” enough votes to swing the election in Trump’s favor. Legally, that won’t change the outcome of the election in Maricopa County, but come on, we all know that Trump will grab onto that result and head straight to court to challenge his election loss.
He will also demand audits in other states that he lost that he feels he should have won. And when votes are “found” in those states as we all know will happen, Trump will file more challenges.
He will lose, as he lost all of his court challenges in the immediate aftermath of the election, but all of these fake audits and fake challenges will undermine the legitimacy of Biden’s win and his presidency in the eyes of voters and possibly the eyes of the rest of the world.
That will make it difficult to get his economic plans passed in Congress as well as undermine his diplomatic efforts around the world.
All because Trump is unable to accept that he lost the election.
