Two Students File Lawsuit Against Mt. SAC for Rape Coverup

Former student Aarefah Mosavi files lawsuit against college for rape, second student comes forward

Two women have filed a lawsuit against Mt. SAC for allegedly covering up a rape and sexual assault on campus.

A second accuser has come forward in the continuing case that accuses Mt. SAC of covering up a sexual assault. The lawsuit was filed today by BAMN, The Coalition to Defend Affirmative Action, Integration, and Immigrant Rights and Fight for Equality By Any Means Necessary, on behalf of Aarefah Mosavi, a former Mt. SAC student and current University of California Berkeley student.

According to the lawsuit filed, Angela Consolacion, a student and former employee of Mt. SAC, claims she was sexually assaulted by Esau Gatsi, a Mt. SAC student, while at work on the campus. Consolacion claims she made the administration aware of this sexual assault and nothing came of her report to her supervisors.

The lawsuit documents Consolacion’s incident, where she was tutoring Gatsi in May 2014. She said Gatsi wanted to give her a tip, but Consolacion declined. She said that Gatsi then took the money and stuffed it down her shirt. The following week, Consolacion told her supervisor Bailey Smith to assign Gatsi to someone else. Smith never got back to Consolacion on her rights to file a complaint. The tutoring service moved Consolacion to the math building and allowed Gatsi to continue getting services. According to the lawsuit, there were times when Gatsi came to the math building and she had to hide in the break room to avoid contact with him.

Aarefah Mosavi accused Mt. SAC employee Chester Brown of sexual assault in a video released on YouTube. Mosavi accused Mt. SAC administration of attempting to cover up the alleged assault, and said that the investigation of the claims were not handled properly.

The lawsuit filed today on behalf of Mosavi and Consolacion documents the already public statements made by Mosavi on YouTube.

BAMN wrote in the lawsuit that they request a trial by a jury on plaintiffs’ claim of sexual harassment, retaliation, religious discrimination, rape, assault, and other unconstitutional discrimination.

BAMN lists in the lawsuit they want compensatory damages on all causes of action against all defendants, punitive damages, attorney’s fees pursuant to applicable statute, for costs of suit herein incurred, and for other and further relief as the Court deems proper.

The lawsuit names defendants Chester Brown, Esau Gatsi, President Bill Scroggins, Director of Equal Employment Opportunity Lorraine Jones, Vice President of Human Resources James Czaja, Math Tutoring Center Supervisor Bailey Smith, and John Cardenas.

A press conference will be by BAMN today, June 3, at 3p.m., in front of the TMARC bldg.
