Understanding Certificate of Relief from Disabilities in New York

In New York State, a Certificate of Relief from Disabilities (CRD) is a legal document that can help people with criminal convictions overcome some of the barriers they face when trying to rebuild their lives.

What it does:

  • Reduces barriers to employment: Many jobs and licenses have restrictions against people with certain convictions. A CRD can remove these automatic disqualifications, requiring employers and licensing agencies to consider your application fairly.
  • Helps with housing: A CRD can make it easier to get approved for public housing or other housing opportunities.
  • Restores some rights: While it doesn’t clear your record, a CRD can restore certain rights that might have been lost due to your conviction.

Who is eligible:

  • You can get a CRD if you have been convicted of any number of misdemeanors or violations, but have not been convicted of more than one felony. (Two or more felony convictions in the same court on the same day count as one felony for CRD purposes.)
  • If you have two or more felonies (not at the same time) or want to apply for public office, you can’t apply for a CRD, but you might be eligible for a Certificate of Good Conduct.

Important points:

  • Doesn’t erase your record: A CRD doesn’t seal or expunge your conviction. You still need to disclose it on applications if asked.
  • Doesn’t guarantee approval: While a CRD removes automatic barriers, it doesn’t guarantee you’ll get a job, license, or housing. Employers and agencies can still consider your conviction when making decisions.

How to apply:

You can apply for a CRD through the court where you were sentenced. You’ll need to fill out an application and provide certain documents, such as a copy of your criminal record.

Benefits:

  • Increased employment opportunities
  • Improved access to housing
  • Greater chance at a fresh start

If you have a criminal conviction in New York State, a Certificate of Relief from Disabilities can be a valuable tool in your efforts to move forward.
