

The calculus of supposedly “sharing economy” businesses is no different than that of GM or Toyota calculating the cost of recalls vs. that of lives lost. Only in the case of Internet startups, the refusal to accept any responsibility for liability or human costs is a philosophy — an ethos — embedded into the platform itself.
The legal relationships in AirBNB are different than HomeAway/VRBO. In AirBNB, the renter contracts with AirBNB and the owner contracts with AirBNB. In the HomeAway/VRBO, the owner contracts directly with the renter; HomeAway/VRBO are facilitators and not named parties to the contract.
I am saddened by your loss. Part of me wish to blame AirBnB and the entire “sharing economy”.
