Dassey

Today marks a new page in the annals of justice. For a culture obsessed with true crime, be it “Serial” or “Making A Murderer”, today is a day of celebration.
Brenden Dassey has been locked up since 2005 after “confessing” to helping his uncle, Steven Avery, murder and dispose of the body of a Teresa Halbach. If you watched Making A Murderer you were probably left scratching your head after seeing the video of the confession that locked this young man up. Simply put, he isn’t all there upstairs and he was lead to say something the interviewer wanted him to say.
Today, US District Court Magistrate Judge William Duffin ruled that Dassey’s confession was “involuntary under the 5th and 14th Amendments”. Why you ask? Well, because investigators made “false promises” and interviewed Dassey without the presence of an adult, knowing he had learning disabilities.
Len Kachinsky, Dassey’s lawyer, also got blasted for attempting to convince his client to confess. I client he knew had learning disabilities. “Although it probably does not need to be stated, it will be: Kachinsky’s conduct was inexcusable both tactically and ethically,” Duffin stated in his ruling. “It is one thing for an attorney to point out to a client how deep of a hole the client is in. But to assist the prosecution in digging that hole deeper is an affront to the principles of justice that underlie a defense attorney’s vital role in the adversarial system.”
The state now has 90 days to either let him go or retry him. I sincerely hope they just let him walk. Here is a crazy idea, get it right this time.
